Standards for examination and consideration for civil servant promotion in Vietnam

(1) Criteria and conditions for taking the civil servant promotion exam in Vietnam

Civil servants may register for the rank promotion exam when they fully meet the following criteria and conditions:

- Being graded at the level of completing tasks well or higher in the working year immediately preceding the year of competition for rank promotion; having good political and moral qualities; not within the time limit for disciplinary action, not during the implementation of the regulations related to discipline specified in Article 82 of the Law on Cadres and Civil Servants as amended and supplemented in Clause 17, Article 1 of the Law amending a number of articles of the Law on Cadres and Civil Servant and the Law on Public Employees;

- Having the capacity, professional qualifications, and skills to take on a job position corresponding to the rank of civil servant higher than the rank of civil servant currently held in the same professional field;

- Satisfying the requirements for diplomas, certificates, and other requirements on professional and professional standards of the competition category;

In cases where civil servants have professional diplomas that have standardized output in foreign languages or informatics according to regulations, that correspond to the requirements of the exam grade, they must satisfy the requirements on foreign language and informatics standards of the exam grade. .

In cases where civil servants are exempted from foreign language or computer science exams according to the provisions of Clauses 6 and 7, Article 37 of Decree 138/2020/ND-CP, they must meet the requirements of foreign language and computer science standards for the exam.

- Satisfy the requirements on the minimum working time for each civil servant rank specified in the professional and professional standards of the competition category;

In case a public employee who has worked for a period of time before being recruited or accepted has paid compulsory social insurance in accordance with the provisions of the Law on Social Insurance, working in a position that requires appropriate professional qualifications (if the working time is not continuous without receiving the lump-sum social insurance allowance, it will be accumulated), and that time is calculated by the competent authority as the basis for salary ranking in the current civil servant rank, it shall be counted as equivalent to the current civil servant rank.

In case of equivalent duration, they must have at least 01 year (full 12 months) of holding the lower rank adjacent to the exam grade by the end of the time limit for submitting the application for registration for the rank promotion exam.

(2) Criteria and conditions for considering raising the rank of civil servants

Civil servants who fully satisfy the criteria and conditions specified at Points a, b and c, Clause 3, Article 30 of Decree 138/2020/ND-CP shall be considered for promotion to the rank of civil servant in the following cases:

- Having outstanding achievements in public service activities during the time of holding the current civil servant rank, which is recognized by a competent authority;

- Being apointed to hold leadership and management positions in association with the requirements of the job position.

What documents are required for civil servant promotion in Vietnam?

(i) Pursuant to Clause 1, Article 36 of Decree 138/2020/ND-CP, the application file for civil servant promotion includes:

- Curriculum vitae of civil servants according to current regulations, made no later than 30 days before the deadline for submission of applications for promotion, certified by the agency that manages and employs the civil servant;

- The comment and assessment of the head of the agency or organization employing the civil servant on the criteria and conditions for registration of the exam as prescribed;

- Copies of diplomas and certificates at the request of the exam category;

If the civil servant has a professional diploma with output standards in foreign languages or informatics according to regulations that correspond to the requirements of the exam category, he/she is not required to submit a foreign language or informatics certificate.

In cases where civil servants are exempt from taking foreign language or computer science subjects as prescribed in Clauses 6 and 7, Article 37 of Decree 138/2020/ND-CP, they are not required to submit foreign language or informatics certificates.

- Other requirements according to regulations on the professional standards of civil servant ranks.

(ii) Pursuant to Clause 2, Article 36 of Decree 138/2020/ND-CP, in addition to the papers in item (i) above, the dossier for consideration of civil servant rank promotion must also contain copies of documents proving the standards and conditions for consideration of civil servant rank promotion as prescribed in Article 31 of Decree 138/2020/ND-CP.
