1. What are the titles of commune-level cadres and civil servants in Vietnam?

Commune-level officials have the following positions:

+ Secretary, Deputy Secretary of the Party Committee;

+ President, Vice Chairman of the People's Council;

+ President, Vice Chairman of the People's Committee;

+ Chairman of Vietnam Fatherland Front Committee;

+ Secretary of the Ho Chi Minh Communist Youth Union;

+ President of Vietnam Women's Union;

+ President of the Vietnam Farmers' Association (applicable to communes, wards, and townships engaged in agricultural, forestry, fishery, and salt production activities and organized by the Vietnam Farmers' Association);

+ President of Vietnam Veterans Association.

- Commune-level civil servants have the following titles:

+ Chief of Police;

+ Military commander;

+ Office – statistics;

+ Cadastral - construction - urban and environment (for wards and townships) or cadastral - agriculture - construction and environment (for communes);

+ Finance - accounting;

+ Justice – civil status;

Culture and society.

(Article 3 of Decree 92/2009/ND-CP)

2. Number of commune-level cadres and civil servants in Vietnam

- The number of commune-level cadres and civil servants shall be arranged according to the Decision on classification of administrative units of communes, wards, and townships. As follows:

+ Type 1: up to 23 people;

+ Type 2: up to 21 people;

+ Type 3: up to 19 people.

- The People's Committees of the provinces and centrally-run cities shall decide to arrange the number of commune-level cadres and civil servants equal to or lower than the above provisions, ensuring compliance with the titles specified in Article 3 of Decree 92/2009/ND-CP and suitable to the actual situation of the locality.

For communes and townships where commune police chiefs are regular police, the number of above-mentioned officials and civil servants will be reduced by 01 person.

- Number of superior commune-level cadres and civil servants, including cadres and civil servants who are rotated, transferred, or seconded to commune level.

Particularly, in case of rotation to assume the position of Vice President of the Commune People's Committee, Decree 08/2016/ND-CP shall be followed.

3. Some benefits for commune-level cadres and civil servants in Vietnam

(1) Social insurance and health insurance

- Commune-level officials specified at Points a and b, Clause 1, Article 5 of Decree 92/2009/ND-CP; commune-level civil servants specified at Points a, b, and c, Clause 2, Article 5 of this Decree and commune-level cadres and civil servants specified in Clause 3, Article 5 of Decree 92/2009/ND-CP while holding a position or title subject to participation in compulsory social insurance and health insurance as prescribed by law.

- In case commune-level cadres and civil servants have reached the end of working age when they retire, have spent from full 15 years to less than 20 years paying compulsory social insurance premiums, have not received lump-sum social insurance benefits, or have a need to participate in voluntary social insurance, they will continue to pay according to the provisions of Decree 190/2007/ND-CP until full 20 years of paying social insurance premiums and will be entitled to a monthly pension.

(2) Training and retraining

- Commune-level cadres and civil servants are trained and foster knowledge in accordance with the standards of the titles currently in charge and according to the cadres and civil servants plans.

- Commune-level cadres and civil servants, when sent for training and retraining, are entitled to the following regimes:

+ Being provided with learning materials;

+ Being partially supported for meals during the concentrated study period;

+ Support for travel expenses from the office to the place of study.
