Regarding this issue, LawNet would like to answer as follows:
According to Article 26 of the Law on Road Traffic 2008, when participating in traffic on expressways, drivers in Vietnam must comply with the following regulations:
- Drivers and operators of special-use vehicles traveling on expressways, apart from complying with traffic rules provided in this Law, shall also observe the following provisions:
+ When entering an expressway, to give signals indicating the intention to do so and give way to vehicles traveling on the expressway, only when making sure that it is safe can they join in the traffic lane on the lane close to the edge of the expressway;
If there is an acceleration lane, they shall use it before moving into the expressway lane;
+ When exiting an expressway, to move gradually to the right lane, if there is a deceleration lane, they shall enter such lane before leaving the expressway;
+ Do not move on the emergency-stop lane or the verge;
+ Do not move beyond the maximum speed and below the minimum speed, which are indicated on the road signs or painted road markings.
- Drivers or operators of special-use vehicles shall keep at a safe distance from one another as indicated on the road signs.
- To stand or park their vehicles only at the prescribed places; where they are compelled to stand or park their vehicles outside the prescribed places, the drivers shall move their vehicles off the carriageway; if unable to do so, they shall give signals to the drivers of other vehicles.
- Pedestrians, rudimentary vehicles, motorcycles, mopeds and tractors; and special-use vehicles with a design speed of less than 70 km/h may not enter expressways, except persons, vehicles and equipment used for expressway administration and maintenance.
Thus, the vehicle is only allowed to stop and park at the specified place; In case the vehicle is forced to stop or park at the wrong place, the driver must take the vehicle out of the roadway; if it is not possible, he must give a signal to other drivers to know.
According to Clause 7, Article 5 of Decree 100/2019/ND-CP (amended in Decree 123/2021/ND-CP), a fine ranging from VND 10,000,000 to VND 12,000,000 shall be imposed upon a vehicle operator who commits any of the following violations:
- Failure to observe, operating the vehicle exceeding speed limit thus causing accidents;
Stopping, parking, making a u-turn, backing, avoiding, overtaking, changing direction or changing lanes against regulations and law causing accidents; failure to operate in correct sections, lanes, failure to maintain safety distance between 2 vehicles as per the law thus causing accidents or entering roads erected with signs prohibiting entry of operated vehicles, going against traffic direction on one-way roads or on roads erected with “Cấm đi ngược chiều” (No entry) signs causing accidents, except for violations specified in Point a Clause 8 of Article 5 of Decree 100/2019/ND-CP;
- Weaving, speeding, chasing on public roads; steering a vehicle running on public roads with the legs;
- Exceeding the speed limits by more than 35 km/h.
- Stopping or parking on freeway in locations against regulations and law; failure to provide signals to inform other drivers in case of compulsory stop or parking on freeway at an undesignated location; making a u-turn on freeway;
At the same time, the violating vehicle operator will also have his driving license revoked from 02 months to 04 months according to point b, clause 11 Article 5 of Decree 100/2019/ND-CP.
From the above regulation, those who stop and park on the highway in contravention of regulations will be fined from 10 million VND to 12 million VND and have their driving license revoked from 02 months to 04 months.
