Regulations on the management and use of tuition in 2024 in Vietnam

Following article presents the management and use of tuition according to current legal regulations. It includes regulations on the collection of tuition by educational institutions in Vietnam.

1. Regulations on the Collection of tuition by Educational Institutions in 2024

According to Article 12 of Decree 81/2021/ND-CP, the collection of tuition is regulated as follows:

- tuition are collected monthly; if students voluntarily agree, schools may collect fees in one installment for an entire semester or academic year. For continuing education institutions, regular training, and short-term training courses, tuition are collected based on the actual number of months studied. For preschool and general education institutions, tuition are collected for a maximum of 9 months per year. For higher education and vocational education institutions, tuition are collected for a maximum of 10 months per year.

- In the event of natural disasters, epidemics, or force majeure events, tuition are collected based on the actual months of study (including the period of organizing online teaching or arranging make-up classes at school); tuition are not collected during periods when teaching is not organized. The tuition fee collection level must ensure the principle based on the actual number of months studied and necessary incurred costs to organize teaching, but not exceed the total tuition fee calculated based on the maximum number of months in one academic year (maximum 9 months per year for preschool and general education, and maximum 10 months per year for higher education and vocational education) and must be publicly announced at the beginning of the academic year in educational institutions. The Provincial People's Committee submits to the People's Council to decide the specific time for collection, and the tuition fee level for public preschool and general education on the locality; Heads of higher education institutions and vocational education institutions stipulate the collection time and tuition fee level in the case of natural disasters, epidemics, or force majeure events.

- In the case of organizing teaching and learning according to the credit system, educational institutions may convert to collect tuition per credit; however, the total tuition fee collected per credit for the entire course must not exceed the tuition fee level prescribed for the course if collected annually.

- Educational institutions are responsible for organizing the collection of tuition and depositing tuition into commercial banks or the State Treasury for management and use. In the event of cash collection of tuition, periodically, the unit must complete procedures to transfer (deposit) all remaining cash tuition collected at the fund into the unit's account at the State Treasury or a commercial bank for management in accordance with regulations.

2. What is the guidance on management and use of tuition in 2024 in Vietnam?

According to Article 13 of Decree 81saa/2021/ND-CP, the guidance on the management and use of tuition is as follows:

- Public educational institutions use tuition following the Government of Vietnam's regulations on the financial autonomy mechanism of public service providers and incorporate them into the annual financial reports of the educational institution as prescribed by law.

- Non-public, private educational institutions use tuition according to the principle of self-assurance of revenue and expenditure and are responsible for financial management related to their activities. They organize accounting work, pay taxes, and fulfill other financial obligations in accordance with the law.

- Educational institutions manage tuition fee income and expenditure according to accounting, audit, tax policies, and publicly disclose finance as prescribed by law; fulfill requirements for inspection and examination by financial agencies and competent educational management agencies and are legally responsible for the accuracy and honesty of the information and documents provided.

- Educational institutions, before enrollment or selection, must announce and publicize the tuition fee level, training costs for each academic year, education level for preschool, and general education, the tuition fee increase roadmap (if any) for each academic year, and the forecast for the entire course for higher education.

- Educational institutions are responsible for publicizing and explaining training costs, the tuition fee level, the tuition fee increase roadmap for each academic year, education level, course; publicizing conditions ensuring quality according to regulations; publicizing the policy of fee exemption, reduction, and the level of exemption and reduction in the event of natural disasters, epidemics, or force majeure events.
