According to Article 31 of the Land Law 2024, the general obligations of land users in Vietnam are stipulated as follows:
(1) Use the land for the correct purposes, within the boundary limits of the parcel, conform to the regulations on underground and aerial usage, protect public infrastructure underground, and comply with other relevant legal regulations.
(2) Declare and register land; complete necessary procedures when converting, transferring, leasing, subleasing, inheriting, gifting, mortgaging, or using land use rights as capital according to the law.
(3) Fulfill financial obligations regarding land according to the law.
(4) Implement measures to protect, treat, improve, and restore polluted or degraded land caused by their activities.
(5) Comply with environmental protection regulations, ensuring no harm to the legal assets and interests of related land users.
(6) Adhere to legal regulations on discovering underground objects.
(7) Surrender the land when the State decides to repossess it according to the law.
According to Article 26 of the Land Law 2024, the general rights of land users in Vietnam are stipulated as follows:
(1) Be issued a Certificate of land use rights, ownership of assets attached to the land when meeting the conditions set by law.
(2) Enjoy the results of labor and investments on legally used land.
(3) Enjoy benefits when the State invests in the protection, improvement, and development of agricultural land.
(4) Receive guidance and assistance from the State in improving and restoring agricultural land.
(5) Have their rights and legal interests protected by the State when infringed by others.
(6) Have the right to change the land use purposes according to the Land Law 2024 and other relevant legal regulations.
(7) Receive compensation, support, and resettlement when the State repossesses the land according to the Land Law 2024.
(8) Appeal, file lawsuits, or denounce violations of their legal land use rights and other violations of land law.
Based on Article 11 of the Land Law 2024, the following actions are prohibited in the field of land:
(1) Encroaching, seizing, or destroying land.
(2) Violating state land management regulations.
(3) Violating land policies related to ethnic minorities.
(4) Abusing position and power to contravene land management regulations.
(5) Not providing information or providing inaccurate land information, not meeting the legal deadlines.
(6) Failing to prevent or handle land law violations.
(7) Not complying with legal regulations when exercising land use rights.
(8) Using land and conducting land use rights transactions without registering with the competent authorities.
(9) Not fulfilling or inadequately fulfilling financial obligations to the State.
(10) Obstructing or complicating land usage and the exercise of land use rights according to the law.
(11) Gender discrimination in land management and usage.
