According to Article 8 of the Law on Disaster Prevention and Control 2013, the sources of funding for disaster prevention and control include:
- State budget.
- Disaster prevention and control fund.
- Voluntary contributions from organizations and individuals.
- Other sources as prescribed by law.
Article 9 of the Law on Disaster Prevention and Control 2013 (amended by the Law on Amendments and Supplements to Several Articles of the Law on Disaster Prevention and Control and the Law on Dykes 2020) provides detailed regulations on the state budget for disaster prevention and control as follows:
- The state budget for disaster prevention and control includes the annual budget, contingency state budget, and financial reserve fund.
- The state budget for disaster prevention and control is used for the development and implementation of strategies, plans, fundamental investigations of disaster prevention and control; investment in construction, repair, and upgrading of disaster prevention and control works; disaster prevention and control activities; regular activities of state management agencies in charge of disaster prevention and control at all levels.
The preparation of estimates, allocation, management, and use of the state budget for disaster prevention and control is conducted in accordance with the provisions of the law on the state budget and other relevant legal regulations.
- Contingency state budget for disaster prevention and control is used in accordance with the following regulations:
+ Support for disaster response and recovery efforts;
+ Based on response activities, level of damage, relief needs, and policies, the People's Committees at all levels decide on the use of local contingency budgets to address urgent needs for disaster response and recovery beyond the annual approved expenditure estimates;
+ In cases where the local contingency budget has been utilized but does not meet the needs, the Chairman of the provincial People's Committee shall propose to the Prime Minister of the Government of Vietnam for support. The National Steering Committee on Disaster Prevention and Control aggregates the damage situation, local support needs, and proposes to the Prime Minister to decide.
+ The financial reserve fund is utilized for disaster prevention, mitigation, and recovery duties with a severe level, arising beyond the estimates, where after reallocating the budget, exhausting contingency budgets, there still aren't enough resources as per the provisions of the law on the state budget.
Article 10 of the Law on Disaster Prevention and Control 2013 (amended by the Law on Amendments and Supplements to Several Articles of the Law on Disaster Prevention and Control and the Law on Dykes 2020) regulates the disaster prevention and control fund as follows:
- The disaster prevention and control fund is a public financial fund beyond the budget, including the central disaster prevention and control fund managed by the Ministry of Agriculture and Rural Development and the provincial disaster prevention and control fund managed by the provincial People's Committees.
- The financial sources of the disaster prevention and control fund are regulated as follows:
+ The financial sources of the central disaster prevention and control fund include support, voluntary contributions from domestic and foreign organizations and individuals; redistribution from the provincial disaster prevention and control fund as decided by the Prime Minister of the Government of Vietnam, and other lawful sources;
+ The financial sources of the provincial disaster prevention and control fund include support, voluntary contributions from domestic and foreign organizations and individuals; mandatory contributions from domestic and foreign economic organizations in the locality, Vietnamese citizens aged from 18 to retirement age under normal working conditions as prescribed by labor law; redistribution from the central disaster prevention fund among provincial disaster prevention funds and other lawful sources.
- The operating principles of the disaster prevention and control fund are prescribed as follows:
+ Non-profit oriented;
+ Manage and use for the right purposes, in accordance with the law, promptly, effectively, ensuring transparency and openness;
+ Support for disaster prevention activities not yet funded or adequately addressed by the state budget.
