Regulations on voluntary rehabilitation in rehabilitation centers in Vietnam

According to Article 31 of the Law on Prevention and Control of Narcotic Substances 2021, voluntary drug detoxification at drug detoxification establishments is as follows:

- Voluntary rehabilitation in rehabilitation centers shall last from 06 to 12 months.

- Persons undergoing voluntary rehabilitation in rehabilitation centers are entitled to financial assistance for their rehabilitation after they have completed at least 03 stages provided for in Points a, b and c Clause 1 Article 29 of the Law on Prevention and Control of Narcotic Substances 2021.

- Responsibilities of persons undergoing voluntary rehabilitation in rehabilitation centers:

+ Fully comply with regulations on voluntary rehabilitation and guidelines from specialized agencies;

+ Pay rehabilitation-related costs according to regulations.

Persons in difficult conditions undergoing voluntary rehabilitation in public rehabilitation centers may be exempt from paying all or part of the costs incurred.

- Rehabilitation centers shall issue confirmations of completion of voluntary rehabilitation to persons having completed the rehabilitation.

- The Government shall elaborate Article 31 of the Law on Prevention and Control of Narcotic Substances 2021 in Decree 116/2021/ND-CP.

Contract for voluntary rehabilitation in rehabilitation centers in Vietnam

Pursuant to Article 36 of Decree 116/2021/ND-CP stipulating voluntary drug addiction service contracts as follows:

A contract for voluntary rehabilitation includes the following main contents:

+ Subjects of the contract: organizations and individuals providing drug detoxification services with drug addicts or legal representatives of drug addicts from full 12 years old to under 18 years old on the provision and use of voluntary drug detoxification services;

+ Objects of the contract (type of service, form of service provision, time and location of drug addiction treatment...);

+ The service use price and form;

+ Rights and obligations of detoxification establishments and detoxicators in providing and using detoxification services;

Liability for breach of contract; cases of compensation for damage, reduction of service use costs; cases of unilateral termination of service contract performance or continuation of service contracts;

Date of entry into force and termination of the contract.

- Form of contract for drug addiction treatment service according to Form No. 28, Appendix II of Decree 116/2021/ND-CP.

Procedures for applying for voluntary rehabilitation in rehabilitation centers in Vietnam

According to Article 35 of Decree 116/2021/ND-CP, the procedures for applying for voluntary rehabilitation in rehabilitation centers in Vietnam are as follows:

- Drug addicts aged full 12 years or older who wish to detox from drug addiction may apply for voluntary rehabilitation in rehabilitation centers.

- Application for voluntary rehabilitation in rehabilitation centers include:

+ 01 registration of voluntary detoxification according to Form No. 22, Appendix II of Decree 116/2021/ND-CP;

+ 01 photocopy of one of the identification papers: citizen identification, identity card, passport or birth certificate (for persons aged from full 12 to under 18 years) of the detoxifier.

- The order of execution:

+ A drug addict from full 18 years old or a legal representative of a drug addict from full 12 years old to under 18 years old shall submit 1 set of dossiers as prescribed in Clause 2, Article 35 of Decree 116/2021/ND-CP at a drug detoxification establishment; present the original of one of the identification papers for comparison;

+ Drug addiction treatment establishments receive dossiers, check, compare and advise on drug detoxification plans; information on drug addiction treatment services available at the facility, the level of costs for using the facility's drug addiction treatment services, other expenses, contributions and support regime for detoxifiers (if any);

+ Drug addicts or their legal representatives from full 12 years old to under 18 years old and representatives of drug detoxification establishments reach agreement and agree to sign drug addiction service contracts;

+ The drug addiction service contract must be sent: 01 copy to the drug addict, the legal representative of the drug addict from full 12 years old to under 18 years old, 01 copy to the commune-level People's Committee where the detoxifier registers for voluntary detoxification as prescribed.
