The Department of Agriculture and Rural Development is a specialized agency of the Provincial People's Committee in Vietnam

According to Circular 30/2022/TT-BNNPTNT, the Department of Agriculture and Rural Development is a specialized agency under the Provincial People's Committee, performing the function of advising and assisting the Provincial People's Committee in state management of: agriculture; forestry; career salt; Seafood; irrigation; natural disaster prevention and control; rural development; food quality and safety for agricultural, forestry, aquatic and salt products; public services in agriculture and rural development in accordance with the law.

The Department of Agriculture and Rural Development has legal status, its own seal, and its own account. It is under the direction and management of the People's Committee of the province and, at the same time, subject to the direction, guidance, inspection, and examination of expertise of the Ministry of Agriculture and Rural Development.

What documents does the Department of Agriculture and Rural Development submit to the Chairman and Provincial People's Committee?

Also according to Circular 30/2022/TT-BNNPTNT, the Department of Agriculture and Rural Development submits to the Provincial People's Committee:

- Draft decision of the provincial People's Committee related to the fields under the management of the Department and other documents as assigned by the provincial People's Committee;

- Draft plans, programs, projects, schemes, and measures to organize the implementation of tasks related to agriculture and rural development under the management of the Department in the province;

- Draft decision on decentralization and delegation of state management tasks in the field of agriculture and rural development to Departments and district-level People's Committees according to regulations;

- Draft decision stipulating the functions, tasks, powers, and organizational structure of the Department and its sub-departments; draft decision on establishment, reorganization, and dissolution of public non-business units under the Department according to the provisions of law;

- Draft decision on socialization of public non-business service provision activities in the field of agriculture and rural development under the authority of the People's Committee of the province and according to the decentralization of the superior state agency .

In addition, submitted to the Chairman of the Provincial People's Committee:

- Draft documents under the promulgation competence of the President of the provincial People's Committee as assigned;

- Draft decision stipulating functions, tasks, powers, and organizational structure of public non-business units under the Department;

- Draft regulations on management, work coordination, and reporting regimes of provincial-level agriculture and rural development organizations located in districts with district-level People's Committees; professional and technical staff in the agriculture and rural development sectors working in communes with commune-level People's Committees.

Tasks and powers of the Department of Agriculture and Rural Development regarding natural disaster prevention in Vietnam

- Advising and submitting to the People's Committees of provinces for promulgation according to their competence or submitting to competent authorities: plans for natural disaster prevention and control, plans for investment in the construction of works for natural disaster prevention and control in the locality as assigned; standards and norms of supplies, means, and equipment used for natural disaster prevention and control;

Deciding on the organization of the construction, management, exploitation, and use of databases and specialized monitoring and supervision systems for natural disaster prevention and control; decide to approve and announce the results of the basic investigation on natural disaster prevention and control in the province; decide to declare emergency situations on natural disasters as assigned by the provincial People's Committees; decide on specialized dike management force and people's dike management force; regimes and policies for people's dike management force, dike patrol, and guard force;

Licensing for dyke-related activities; use of riverbanks, floating beaches, and islets related to flood drainage and dykes; approve the construction and renovation of traffic works related to dykes;

- Guiding and inspecting the implementation of the master plan on flood prevention and control of river lines with dikes, dyke planning and plans for flood prevention and control of river routes with dikes; dike system development plan in the provincial planning, investment in construction, renovation, upgrading, and solidification, maintenance and repair of dykes, management and safety of dykes as assigned or authorized by the provincial People's Committees ;

- Guiding and organizing the assessment of the current state of the dike, determining the key dike key points; inspect the construction and implementation of dike protection plans, dyke protection work, and ensure dyke safety; synthesize and manage information and data on dykes within the province;

- Guiding and inspecting the investment in construction, maintenance, maintenance, operation and protection of natural disaster prevention and control works in the province according to the provisions of law and assignment of the provincial People's Committee;

- Propagating and disseminating content that meets requirements for natural disaster prevention and control for the management, operation, and use of mineral mining zones and other natural resource exploitation zones; urban areas; tourist spots, tourist areas; industrial areas; historic districts; rural residential areas and works;

- Performing tasks as prescribed by law on planting landmarks to limit the protection scope of dike works; developing plans and measures to relocate works and houses related to the protection scope of dykes and riverbanks according to regulations.
