Regarding this issue, LawNet would like to answer as follows:

1. What are the cases required to make chemical safety data sheets in Vietnam?

According to Clause 1, Article 29 of the Law on Chemicals 2007, for hazardous chemicals, chemical safety data sheets must be made.

Hazardous chemicals include hazardous substances or mixtures with the content of hazardous substances exceeding the prescribed limit. 

Hazardous chemical means a chemical having one or several of the following hazardous properties according to classification principles of the Globally Harmonized System of Classification and Labeling of Chemicals:

- Explosive;

- Strongly oxidative;

- Strongly corrosive;

- Flammable;

- Acutely toxic;

- Chronically toxic;

- Causing irritation to humans;

- Causing cancer or posing threats of causing cancer;

- Causing genetic mutation;

- Reproductively toxic;

- Bio-accumulative;

-Organically polluting and hard to decay;

- Environmentally toxic.

(Clause 4, Article 4 of the Law on Chemicals 2007)

2. What is included in the chemical safety data sheet?

Specifically, in Clause 3, Article 29 of the Law on Chemicals 2007, a chemical safety data sheet contains the following contents:

- Identification of the chemical;

- Identification of hazardous properties of the chemical;

- Information on the composition of substances;

- Physical and chemical properties of the chemical-

- Stability and activity of the chemical;

- Information on toxicity;

- Ecological information;

- First-aid measures;

- Fire-fighting measures;

- Incident prevention and response measures;

- Storage requirements;

- Effects on humans and requirements for personal protection devices;

- Requirements on disposal of the chemical;

- Requirements on transportation:

- Applicable technical regulations and laws;

- Other necessary information.

3. Guidelines for making chemical safety data sheets in Vietnam

Guidelines for making chemical safety data sheets in Vietnam according to Appendix 9 issued together with Circular 32/2017/TT-BCT are as follows:

b) Label elements according to GHS (Hazard warnings, instructions for storage, use ..)

c) Other hazardous information (if any, e.g. explosive dust...)

Information about ingredients

Must show one or more of the following information:

Single substance

a) Chemical identification:Common name

b) Other product/chemical identifiers {CAS number; UN number (if any); EC registration number (if any) };

c) Trade name;

d) Impurities and stabilizers affect chemical classification.

Mixture of substances

Chemical identification, concentration, percentage concentration within the specified range of all hazardous substances above the specified threshold

Note: Trade secret information (CBI) regulations take precedence when listing ingredients.

Medical first aid measures

a) Description of measures corresponding to exposure routes (In case of accident with eye contact (splash, wire in eye): Case of skin contact accident (with wire on skin); Case of inhalation accident (inhaling dangerous chemicals in the form of vapors, gases)

b) Serious immediate symptoms/effects and later effects

c) Necessary special first aid directives and instructions

Measures to handle in case of fire

a) Suitable extinguishing media

b) Toxic substances produced when burned (toxic gas, etc.)

c) Necessary means, protective clothing and warnings when fighting fire

Measures to prevent and respond to incidents

a) Protective equipment and incident response procedures

b) Environmental warnings

c) Measures and materials for cleaning after the incident occurs

Requirements for use and storage

a) Measures and conditions to be applied when using and manipulating hazardous chemicals (for example: ventilation, only used in closed systems, use of explosion-proof electrical equipment, internal transportation, etc.)

b) Measures and conditions to be applied when storing (for example: temperature, arrangement, limitations on sources of fire and explosion, substances to avoid general storage ...)

An accurate and complete description of the various ecological harms and the available databases used to identify such harms, including:

a) Information on different routes of exposure (e.g. airway, ingestion, eye/skin contact)

b) Symptoms related to chemical toxicity and ecotoxicity

c) Immediate harm, long-term harm and chronic effects from short-term and long-term exposure.

d) List toxicity parameters (estimate acute toxicity)

Ecological information

a) Toxic to the environment (water and terrestrial)

b) Sustainability, persistence and degradability

c) Bioaccumulation potential

d) Mobility in the soil

d) Other harmful effects

Disposal Information

Description of waste types and information on safe handling and disposal methods, taking into account contaminated packaging

One or more of the following relevant information must be shown:

b) Name of means of sea transport

c) Types of dangerous goods in transportation

d) Packing specifications (if any)

d) Environmental toxicity (ocean pollutant)

e) Transport in large ships

g) Special warnings that users need to pay attention to, to follow in transportation.
