Vietnam: Supplementing 02 types of goods banned from storage in bonded warehouses from November 15

Specifically, Decision No. 27/2020/QĐ-TTg (effective from November 15, 2020) of Vietnam’s Government stipulates that the following 02 types of goods are on the list of imports banned from storage in bonded warehouses:

1. Cigarettes of tobacco or tobacco substitutes: Cigarettes containing tobacco with the 555 or Esse brand and not originating in Vietnam (Code 24.02.20)

2. Spirits: Whiskies of a capacity exceeding 50 ml not originating in Vietnam (Code: 22.08.30.00)

Concurrently, according to Clause 4 Article 85 of the Decree No. 08/2015/NĐ-CP of Vietnam’s Government, commodities of entities entitled to lease bonded warehouses moving from Vietnam which have completed customs clearance for export, commodities moving from overseas countries which are waiting for customs clearance for entry into Vietnam or exit to the third country shall be allowed to move into bonded warehouses for storage. The commodities which are not allowed to be stored at bonded warehouses shall include:

- Commodities detected with brand or Vietnam-origin and name frauds or counterfeits;

- Commodities which are dangerous for human beings or cause environmental pollution;

- Commodities subject to a ban on export, import, temporary suspension from export, import, unless otherwise permitted by the Prime Minister.

Thus, according to the above provisions, from November 15, 2020, in addition to 03 types of commodities which are not allowed to be stored at bonded warehouses including commodities detected with brand or Vietnam-origin and name frauds or counterfeits; commodities which are dangerous for human beings or cause environmental pollution; commodities subject to a ban on export, import, temporary suspension from export, import, there are 02 supplemented commodities which are not allowed to be stored at bonded warehouses including cigarettes containing tobacco with the 555 or Esse brand and not originating in Vietnam and whiskies of a capacity exceeding 50 ml not originating in Vietnam. However, it should be noted that applicable laws on bonded warehouse storage period shall apply to shipments that have been moved into bonded warehouses before November 15, 2020. If they cannot be exported upon expiration of the bonded warehouse storage period, they will have to be re-exported through the initial checkpoint of import.

Besides the list of imports banned from storage in bonded warehouses, according to Clauses 2 and 3 Article 85 of Decree No. 08/2015/NĐ-CP of Vietnam’s Government, commodities of entities entitled to lease bonded warehouses moving from Vietnam which have completed customs clearance for export, commodities moving from overseas countries which are waiting for customs clearance for entry into Vietnam or exit to the third country shall be allowed to move into bonded warehouses for storage.

Commodities coming from overseas countries which are allowed to move into bonded warehouses for storage shall include:

- Commodities of foreign freight owners who have yet to enter into the sale contract with Vietnamese enterprises;

- Commodities of Vietnamese enterprises imported from overseas countries which are looking to be launched to domestic markets or expecting to be exported to the third country;

- Commodities coming from overseas countries which are allowed to move into bonded warehouses for export to the third country.

Commodities coming from overseas countries which are allowed to move into bonded warehouses for storage shall include:

- Commodities of foreign freight owners who have yet to enter into the sale contract with Vietnamese enterprises;

- Commodities of Vietnamese enterprises imported from overseas countries which are looking to be launched to domestic markets or expecting to be exported to the third country;

- Commodities coming from overseas countries which are allowed to move into bonded warehouses for export to the third country.
