Upcoming: Is it allowed to set up fireworks to celebrate the 1-year anniversary of couples in Vietnam?

Currently, the Ministry of Public Security of Vietnam is drafting and collecting public comments for the Draft Decree on the management and use of fireworks to replace Decree 36/2009/ND-CP. Notably, the new regulations allowing citizens to set off fireworks on occasions such as birthdays, anniversaries, etc., have garnered significant attention and interest.

Article 15 of the Draft Decree on the management and use of fireworks in Vietnam stipulates as follows:

Article 15. Use of fireworks

1. Agencies, organizations, enterprises, and individuals with full civil act capacity are allowed to use fireworks in the following cases: Festivals, New Year, birthdays, weddings, conferences, openings, commemorative days.

2. Agencies, organizations, enterprises, and individuals when using fireworks are only permitted to purchase fireworks from organizations and enterprises authorized to produce and sell fireworks.

Individuals aged 18 and above (not being deprived of or restricted in their civil act capacity or not experiencing difficulties in cognition and behavior control) are allowed to use fireworks on their commemorative days. Commemorative days or anniversaries are occasions to remember important events in one's life, such as wedding anniversaries, promotion anniversaries, establishment anniversaries of organizations, ... even the 1-year anniversary of being in a relationship is not an exception. Notably, the use of fireworks on these occasions does not require any special permission.

However, the public needs to pay special attention to distinguish between fireworks, explosive fireworks, and firecrackers to avoid violating the law when applying regulations. Article 3 of the Draft Decree outlines the types of fireworks in Vietnam as follows:

Article 3. Terminology Explanation

1. Fireworks are products that contain explosive compounds or firecracker compounds. When impacted by mechanical, thermal, chemical, or electrical stimuli, they cause rapid chemical reactions, generating gas and effects of sound, light, and colors in space, creating explosive sounds or not. Fireworks include explosive fireworks and non-explosive fireworks.

a) Explosive fireworks include:

Explosive fireworks are products manufactured either by handcraft or industry. When impacted by mechanical, thermal, chemical, or electrical stimuli, they produce an explosive sound.

Explosive firecrackers are products manufactured either by handcraft or industry. When impacted by mechanical, thermal, chemical, or electrical stimuli, they produce hissing sounds, explosive sounds, and color effects in space;

b) Fireworks are products manufactured either by handcraft or industry. When impacted by mechanical, thermal, chemical, or electrical stimuli, they produce sound effects, light, and colors in space without causing explosive sounds.

Thus, if the above content in the Draft Decree is passed, when organizing commemorative days such as the 1-year anniversary or several-year anniversaries of a relationship, we are completely allowed to use fireworks to celebrate, but it must be noted that only non-explosive fireworks are permitted and they must be purchased from authorized production and sales enterprises in Vietnam.

Note: According to current regulations in Article 5 of Decree 36/2009/ND-CP, only the following cases are allowed to use fireworks: Organizing fireworks displays when permitted by the Prime Minister; Foreign organizations and individuals permitted by the Prime Minister of Vietnam to participate in fireworks competitions; Using in activities to report tropical depressions, storms, floods, rescue, transportation, and military activities; Using in cultural and art activities.
