Regarding this issue, LawNet would like to answer as follows:
On February 2, 2024, the Prime Minister of Vietnam issued Decision 143/QD-TTg approving the Project "Improving the quality and efficiency of exploitation and use of the Legal Code".
This is one of the tasks proposed in the Project "Improving the quality and efficiency of exploitation and use of the Legal Code" with the following specific contents:
(1) Review, identify and supplement legal regulations that are still in effect but have not been arranged into the Legal Code
- Review and make a list of legal documents containing legal regulations that are still in effect but have not been arranged into the Legal Code and submit to the Prime Minister for approval.
+ The agency implementing the legal code reviews legal documents containing legal regulations that are still in effect and have not been arranged into the legal code under the legal authority of their agency according to the provisions of Article 4 of the Ordinance on the Codification of Legal Normative Systems and make a List and propose plans to update or add new headings (if any) sent to the Ministry of Justice for synthesis and reporting to the Prime Minister for approval.

- Implement legal codes of legal regulations that are still in effect but have not been arranged into the Legal Code according to the plan after being approved by the Prime Minister.
+ "The implementing agency shall carry out the compilation of legal documents for the regulations that are still in effect but have not yet been organized into the Legal Document Set according to the plan approved by the Prime Minister. The compilation of legal documents for the regulations that are still in effect but have not yet been organized into the Legal Document Set shall be carried out in accordance with the provisions on updating new legal regulations and new items into the Legal Document Set, as specified in Article 13 of the Law on the Legal Document System and the regulations on detailed guidance; the results of the compilation shall be sent to the Ministry of Justice for inspection and updating into the Legal Document Set.
+ The Ministry of Justice checks the results of legal codes sent by agencies implementing the codes and updates them to the Legal Code.

(2) Review, handle and improve legal regulations that have not been properly arranged and guided in the Legal Code
- The legal codification agency reviews the codification results under its codification authority that have been arranged into the Legal Code to identify, handle, and perfect legal norms that have not been arranged appropriately and scientifically; The instructions are not complete or accurate. Send the processed and completed legal code results to the Ministry of Justice for checking and updating the Legal Code.
- The Ministry of Justice checks the results of legal codes sent by agencies implementing the legal codes and updates them to the Legal Code.
- Implementing agency: agencies that implement the legal code.
- Coordinating agency: Relevant agencies.
- Output results: The results of the canon have been processed and completed.
- Completion deadline: 2024–2025.
