Regarding this issue, LawNet would like to answer as follows:

To improve the operational capacity of the Land registration office system in Vietnam

On January 19, 2024, the Ministry of Natural Resources and Environment issued Official Dispatch 44/BTNMT-DKDLTTDD on improving the operational capacity of the Land registration office system.

To carry out the task of "Continuing to improve and enhance the capacity of public service organizations in the land field. There are investment mechanisms, remuneration policies, training, fostering and improving the capacity and qualifications of officials and civil servants in the land management sector; Upgrade facilities and equipment to meet modern management requirements" according to the direction of Resolution 18-NQ/TW dated June 16, 2022 of the Central Executive Committee on "Continuing to innovate and perfect institutions and policies, improve the effectiveness and efficiency of land management and use, creating motivation to turn our country into a high-income developed country", the Ministry of Natural Resources and Environment requests the People's Committees of provinces and centrally run cities to pay attention and direct the following contents:

(1) Investing, arranging headquarters, storage, facilities, and working equipment to serve the storage, exploitation, and provision of information to meet the operational needs of the land registration office and its branch.

(2) Concentrate investment resources on surveying, land registration, granting certificates of land use rights, and ownership of houses and other assets attached to land; direct the construction of a land database on schedule as a basis for reforming administrative procedures and promoting digital transformation in the field of land management and use.

(3) Pay attention to allocating enough human resources for the Land registration office system to meet task performance requirements; There are investment mechanisms, remuneration policies, training, fostering, capacity building, and qualifications for all officers and employees of the land registration office system.

(4) Request the People's Committees of 02 provinces of Phu Tho and Quang Ninh to urgently improve the Land registration office system according to the provisions of current land law, to improve the effectiveness and efficiency of handling land procedures and documents.

The People's Committees of these two provinces are responsible before the law for not yet perfecting the Land registration office system according to the provisions of current land law.

Duties and powers of Land registration office in Vietnam

Land registration office is an agency providing public services under the Department of Natural resources and Environment and is formed or reorganized by the relevant provincial People's Committee by merging the existing Office of land use right registration under the Department of Natural Resources and Environment and the existing Offices of land use right under the local Office of Natural Resources and Environment.

In particular, the Land registration office has the following tasks and powers:

- Register land assigned to be managed by the State, register land use rights, and register ownership of houses and other assets attached to land.

- Carry out the initial issuance, renewal, and re-issuance of certificates of land use rights, ownership of houses, and other assets attached to land (hereinafter referred to as Certificates).

- Carry out registration of changes to land assigned to be managed by the State, land use rights, ownership of houses, and other assets attached to land.

- Prepare, edit, update, store, and manage cadastral records; receive and manage the use of Certificate drafts according to the provisions of law.

- Update, adjust, synchronize, and exploit land data; build and manage a land information system according to the provisions of the law.

- Carry out statistics, land inventory, and mapping of current land use status; revise cadastral maps; extract from cadastral map.

- Check the cadastral measurement of the land plot; check and confirm house plans and other assets attached to land provided by organizations and individuals for registration and issuance of Certificates.

- Register secured transactions with land use rights, ownership of houses, and other assets attached to land according to the provisions of the law.

- Provide records, maps, information, and data on land, housing, and other assets attached to land to organizations and individuals according to the provisions of the law.

- Collect fees and charges according to the provisions of the law.

- Perform services based on functions and tasks in accordance with capacity as prescribed by law.

- Manage officials, employees, finances, and assets of the Land registration office according to the provisions of the law; implement a reporting regime according to current regulations; and implement tasks in assigned work areas.
