To focus more on directing the implementation of the Land Law 2024 in Vietnam

On October 10, 2024, the Prime Minister of the Government of Vietnam issued Official Telegram 105/CD-TTg to the Minister of Natural Resources and Environment of Vietnam, Chairpersons of People's Councils, and Chairpersons of People's Committees of provinces and centrally-run cities, requesting them to focus on issuing full regulations outlined in detail by the Land Law and the detailed decrees for implementing the Land Law; to be completed before October 15, 2024.

As of now, according to the report from the Ministry of Natural Resources and Environment, 63 out of 63 provinces and cities have issued detailed regulations complying with the Land Law according to their local authority (including Hai Duong and An Giang provinces which have fully issued the regulations in detail; many cities and provinces have basically completed the detailed issuance of regulations: Danang city, Yen Bai, Lao Cai, Vinh Phuc, Hung Yen, Ha Tinh, Dak Nong, Tay Ninh, Tra Vinh, Bac Lieu, etc.).

However, some provinces and cities are very slow in issuing these documents (including Hai Phong city and the provinces of Lang Son, Khanh Hoa, Dak Lak, Ben Tre, and Soc Trang, which have only issued between 2 to 5 out of the total 20 items required by the Law).

The incomplete issuance of authoritative documents by localities has limited the efficacy of the implementation of the Law, affecting the rights of citizens and businesses, administrative procedures, and the effective enforcement of new policies in the Land Law. The Prime Minister of the Government of Vietnam:

- Strictly criticizes the Chairpersons of People's Councils and People's Committees of Hai Phong city and the provinces of Lang Son, Khanh Hoa, Dak Lak, Ben Tre, and Soc Trang for delays in issuing detailed regulatory documents for implementing the Land Law. Requires reviewing and clarifying the responsibilities of organizations and individuals causing delays in issuing legal documents guiding the implementation of the Land Law.

- Requires Chairpersons of People's Councils, and Chairpersons of People's Committees of provinces and centrally-run cities to fully and promptly implement the directives stated in Official Telegram 105/CD-TTg dated October 10, 2024, from the Prime Minister of the Government of Vietnam regarding focusing on the directive and implementation of the Land Law, with emphasis on fully issuing the detailed regulations outlined in the Land Law and its detailed implementation decrees; the issuance of detailed regulatory documents must be completed by October 31, 2024, and report the results to the Ministry of Natural Resources and Environment for aggregation and reporting to the Prime Minister of the Government of Vietnam. They are responsible before the Government of Vietnam and the Prime Minister if there are delays in issuing the aforementioned documents.

- Assigns the Ministry of Natural Resources and Environment to regularly monitor, urge localities in organizing the implementation of the Land Law and the detailed regulatory documents, guiding the implementation of the Law.

- Assigns Deputy Prime Minister of the Government of Vietnam Tran Hong Ha to direct Ministries, sectors, and localities to strictly and effectively implement this Official Telegram.

- The Office of the Government of Vietnam shall monitor, urge relevant Ministries, agencies, and localities in implementing this Official Telegram, promptly report to the Prime Minister of the Government of Vietnam, and the Deputy Prime Minister responsible for any arising issues, difficulties during the implementation process.
