Regarding this issue, LawNet would like to answer as follows:
According to Article 3 of the draft Circular promulgating the Regulations on recognition of lower secondary school graduation the number of times to consider recognition of lower secondary school graduation in a year is proposed as follows:
- For educational institutions implementing the general education program at the lower secondary level, each year the graduation recognition for learners will be considered no more than 02 (twice) times, as decided by the Department of Education and Training.
- For educational institutions implementing the Continuing Education Program at the lower secondary level, the number of times to consider and recognize graduation for learners each year is decided by the Department of Education and Training.
Meanwhile, in Article 3 of the Regulations issued together with Decision 11/2006/QD-BGD&DT, the number of times to consider and recognize graduation for lower secondary school students is once, immediately after the end of the school year.
For students studying the lower secondary school Continuing Education Program, the Department of Education will submit it to the Provincial People's Committee for decision.
Thus, if this draft is approved, the number of times to consider and recognize the graduation of lower secondary school students will increase, but not more than 02 times/school year.
According to Article 4 of the draft Circular promulgating the Regulations on recognition of lower secondary school graduation, the conditions for recognition of lower secondary school graduation in Vietnam are as follows:
- Regarding age for graduation recognition
+ For students who are studying the general education program at the lower secondary level and are not over 21 years old.
+ For learners who are enrolled in the Continuing Education Program at the lower secondary level from 15 years of age or older.
+ In case a student returns home from abroad, studies beyond the grade level, or studies at an age higher than the prescribed age, the regulations on age according to the educational level of the Ministry of Education and Training must comply with the regulations on age according to the educational level of the Ministry of Education and Training.
- Regarding training results and learning results
+ Learners who are recognized for completing the General Education Program at the lower secondary level or the Continuing Education Program at the lower secondary level (hereinafter referred to as the Middle School Program) during the 9th grade year according to regulations of the Ministry of Education and Training.
+ Learners who have not been recognized for completing the Middle School Program in the 9th grade year because their academic results for the entire year of 9th grade are classified as imqualified (or their academic performance for the entire year is classified as weak or poor) are allowed to register with the educational institution where you attended grade 9 to test and re-evaluate the subjects and be recognized for completing the Middle School Program according to the regulations of the Ministry of Education and Training.
+ Learners who have not been recognized for completing the Middle School Program in the 9th grade year because their training results for the entire year of 9th grade are classified as imqualified (or their conduct for the entire year is classified as weak) are allowed to register for training during the summer vacation of that school year with the educational institution where you attended grade 9 to be re-evaluated and recognized for completing the Middle School Program according to the regulations of the Ministry of Education and Training.
In case the learner does not register for training during the summer vacation of that school year with the educational institution where he/she attended grade 9, to be re-evaluated, he/she must be certified by a competent authority to comply with State policies and laws and local regulations according to the provisions of Point d, Clause 2, Article 5 of the Regulation on recognition of lower secondary school graduation.
+ Learners who have not been recognized for completing the Middle School Program due to missing more than 45 classes in the 9th grade year must register with the educational institution where they attended school to repeat grade 9 and be recognized for completing the Middle School Program according to the regulations of the Ministry of Education and Training.
- Learners who are not serving a prison sentence or whose civil rights are restricted according to the provisions of law, except for students of schools or classes open to people who are serving a prison sentence or whose civil rights are restricted.
