Regarding this issue, LawNet would like to answer as follows:
According to Article 5 of Decree 105/2012/ND-CP, the positions eligible to hold National Funerals are as follows:
- Officials holding or ceasing to hold one of the following positions upon death will have a National Funeral held:
+ General Secretary of the Party Central Committee;
+ President of the Socialist Republic of Vietnam;
+ Prime Minister of the Socialist Republic of Vietnam;
+ Chairman of the National Assembly of the Socialist Republic of Vietnam.
- The Politburo decides to organize the National Funeral Ceremony for other high-ranking cadres who have made great contributions and merits for the revolutionary cause of the Party, State and people, has great reputation domestically and internationally.
Specifically, Article 9 of Decree 105/2012/ND-CP regulates reporting and posting information on the media about the National Funeral as follows:
- Delivering sad news
When there is no official announcement from the Funeral Organizing Committee, the mass media can only briefly report on the death. After the Funeral Organizing Committee was established and the funeral arrangements were officially announced, the mass media reported the sad news and published articles introducing the deceased.
- Post news on media
+ People's Newspaper and central and local press agencies reported on the National Funeral Ceremony, including: Announcement, list of State Funeral Committee, Funeral Organizing Committee; biographies and photos of the deceased; national mourning rites; announcement of the Visitation Ceremony, Memorial Ceremony, Burial Ceremony, and thanks from the State Funeral Committee;
+ Central Science and Documentary Film Studio films the Visitation Ceremony, Memorial Ceremony and Burial Ceremony. The Voice of Vietnam and Vietnam Television, Vietnam News Agency reported and broadcast live the Visitation Ceremony, Memorial Ceremony and Burial Ceremony.
Pursuant to Article 18 of Decree 105/2012/ND-CP stipulating forces and means to serve the National Funeral:
- Funeral service forces prepared by the Ministry of National Defense, including;
+ Forces serving the visitation ceremony: there are 04 (four) officers on duty 1.5 m away from the coffin; 06 (six) soldiers holding CKC guns with bayonets stood outside 0.7 m from the officers on duty; 02 (two) soldiers standing in front of the funeral home; a force carrying flowers; officers leading the funeral; a military music force serving the visitation ceremony;
+ Forces serving the memorial ceremony: there are 04 (four) officers on duty at four corners, 1.5 m away from the coffin; 06 (six) soldiers holding CKC guns are standing outside 0.7 m from the stationed officers; 02 (two) soldiers are standing in front of the funeral home; 01 set of National flags; 01 group of military flags; honorary forces of the three armed services (127 officers and soldiers); military music serving the memorial service;
+ Force serving the funeral: 01 (one) officer carrying a photo, 01 (one) officer wearing a Medal pillow, 01 (one) officer wearing a flag; the working team consists of 01 officer and 12 (twelve) soldiers carrying the coffin; 07 (seven) soldiers prepare hearses; Honorary Service of the Three Military Services;
+ Forces serving the funeral ceremony: 27 (twenty-seven) soldiers on duty at the cemetery gate; 13 (thirteen) soldiers; an honor force of three military branches; and a military music force serving the funeral ceremony.
- Means of service for the funeral prepared by the Ministry of National Defense include: 01 command vehicle; 01 vehicle carrying the national flag, photo, and medal pillow; 01 vehicle carrying the military flag; 06 vehicles carrying the honor squad; 01 flower car; 01 hearse trailer (at the end of the hearse is a 122 mm howitzer); 01 spare vehicle; 02 communication vehicles; and 01 ambulance.
- The coffin covered with the national flag, is placed in a glass cage on the hearse.
