According to Clause 1, Article 34 of Decree 105/2012/ND-CP, the following organizations may hold high-level funerals, including:
+ Cadres and civil servants who hold or resign from positions managed by the Politburo and the Secretariat of the Party Central Committee (except positions where national and state funerals are held);
+ Cadres who participated in revolutionary activities prior to January 1, 1945 (revolutionary veterans) or cadres who operated in the South during the anti-American period (1954-1975) were awarded the Independence Medal, first class or higher.
+ Typical social, cultural, and scientific activists (recipients of the Ho Chi Minh Prize - individual award) and recipients of the First-Class Independence Medal or higher;
+ For typical social, cultural, and scientific activists (who were awarded the Ho Chi Minh Prize - individual awards)—heroes of the People's Armed Forces, and heroes of labor who are working or retired upon his death, a senior funeral was held.
However, in case the deceased person holds one of the titles specified in Clause 1, Article 34 of Decree 105/2012/ND-CP but is disciplined in the form of demotion or dismissal, the funeral ceremony shall be held in the form of funerals for cadres, civil servants, and public employees (according to Clause 2, Article 34 of Decree 105/2012/ND-CP).
The maximum expenditure for high-level funerals from the state budget as prescribed in Article 4 of Circular 74/2013/TT-BTC is VND 60 million for the following:
- Fixed expenses: Up to 45 million VND
+ Expenses to buy coffins: Up to 10 million VND
+ Expenses for making altars: Up to 15 million VND
+ Expenses for building tomb shells: Up to 15 million VND
+ Expenses for buying shrouds and mourning-band: Up to 5 million VND
- Expenses for consideration and decision by the Organizing Committee: Up to 15 million VND
+ Costs for two standard wreaths and fifteen rotating wreaths.
+ Vehicle rental for funeral services.
+ Expenses for recording videos and taking photos.
+ Funeral service expenses.
The place to hold the funeral, according to Article 38 of Decree 105/2012/ND-CP, is:
- In Hanoi: The funeral was held at National Funeral Home No. 5 Tran Thanh Tong in Hanoi.
- In Ho Chi Minh City: Military Hospital 175 Funeral Home or Funeral House No. 25 Le Quy Don, District 3, Ho Chi Minh City
- For other places, they must comply with local regulations.
Burial place of Senior Funeral according to the provisions of Article 39 of Decree 105/2012/ND-CP:
- Burial at Mai Dich Cemetery, Hanoi (if he died in Hanoi), or at Ho Chi Minh City Cemetery (if he died in Ho Chi Minh City) in the following cases:
+ Officials under the supervision of the Politburo;
+ Cadres who participated in revolutionary activities prior to January 1, 1945 (revolutionary veterans) or cadres who operated in the South during the anti-American period (1954-1975) were awarded the Independence Medal, first class or higher.
Typical social, cultural, and scientific activists (awarded the Ho Chi Minh Prize - individual award) and awarded the First-Class Independence Medal or higher.
+ Typical social, cultural, and scientific activists (who were awarded the Ho Chi Minh Prize - individual awards) are Heroes of the People's Armed Forces, Heroes of Labor.
- For the remaining titles, they will be buried at the local cemetery or according to the family's wishes.
- If the family wishes for the deceased to be cremated or buried at home, the Funeral Organization Board is in charge of organizing a high-level funeral in accordance with Decree 105/2012/ND-CP.
