This is the newly collected content for the Draft Decree detailing several provisions of the Labor Code regarding working hours and rest periods, expected to take effect from January 01, 2021.

To be specific, Article 3 of the Draft stipulates the periods considered as work hours eligible for paid wages, including the following durations:
Breaks between shifts counted as work hours in continuous shift work regulated in Clause 2, Article 9 of this Decree.
Rest breaks according to the nature of the work.
Necessary breaks during the labor process included in the labor norm for the natural physiological needs of humans.
A daily 60-minute break for female workers nursing children under 12 months of age.
A daily 30-minute break for female workers during menstruation.
Time stopping work not due to the fault of the worker.
Time for occupational safety and hygiene training.
Time for meetings, study sessions, and training required by the employer or agreed upon by the employer.
Time for meetings, study sessions, and training convened by the superior trade union for non-specialized trade union officials according to the law on trade unions.
10. Time for workers to have health checks, detection of occupational diseases organized by the employer, as stipulated by law.
Therefore, the Current Draft abolishes the shortened work hours of at least 01 hour each day for elderly workers in the last year before retirement as defined in Article 3 of Decree 45/2013/ND-CP and instead includes time for workers to have health checks and detection of occupational diseases organized by the employer, which will be counted as paid work hours.
