According to Instruction 16-HD/TWDTN-BTC 2018, regulations on the rights of union members to nominate and elect leadership agencies at all levels of the Union are as follows:
* Right to run for election:
- Union members have the right to run for election to the executive committee at all levels of the Union, whether the union member is a delegate or not.
- Union members who are not congress delegates and run for election to the Union executive committee at the district level or equivalent level or higher must submit a candidacy application, curriculum vitae, and comments from the executive committee of the grassroots Union where union members are living to the executive committee of the union at the level that convenes the congress at least 15 days before the opening of the congress.
- In case union members living in this locality (unit) are trusted and recommended to be elected to the leadership body of the union in another locality (unit), the union activities must be transferred to that place before implementing the process of introducing candidates (except in designated cases).
For example: if a union member lives in commune A but is trusted to be elected to join the union leadership body of commune B, that union member must transfer union activities to commune B before carrying out the process of introducing candidates.
- At the trade union congress, every union member has the right to stand for election as a delegate to attend the higher-level union congress. In case union members are not present at the congress, they can run for election by petition.
- Official delegates of congresses and conferences of delegates have the right to stand for election as delegates to attend congresses or conferences of superior Union delegates.
* Right to nominate:
- At the union congress, all union members have the right to nominate union members for election to the executive committee and to be elected as delegates to attend the congress of superior union delegates.
- At the congress, official delegates have the right to nominate union members who are delegates and union members who are not delegates for election to the executive committee (In case of nominating union officials who are outside the union member age, they must be official delegates of the congress) or to nominate official delegates to be included in the list to elect delegates to attend the higher-level Union congress.
- In case of the direct election of the secretary at the congress, the official delegates have the right to:
+ Nominate members of the executive committee for election as secretary (according to the first election method in Section 7.4, Article 8 of Instruction 16-HD/TWDTN-BTC 2018).
+ Nominate union members who are delegates or non-delegates to be elected as secretary (according to the second election method in Section 7.4, Article 8 of Instruction 16-HD/TWDTN-BTC 2018).
- Executive committee members have the right to nominate executive committee members for election to the standing committee (where there is no standing committee, nominations can be made to elect secretaries and deputy secretaries).

Regulations on participating in Union activities at the residence of union members in Vietnam according to Instruction 16-HD/TWDTN-BTC 2018 are as follows:
- Union members have the right to participate in Union activities at their place of residence and report to the union branch where they are studying, working, or working.
- Union branches and grassroots unions of communes, wards, and towns are responsible for creating conditions for union members to participate in union activities at their place of residence. The local union branch of residence is responsible for commenting on the union members' participation in activities at their residence when requested by the union members. Comments must be confirmed by the Grassroots Delegation.
- When participating in union activities at their residence, union members are allowed to attend and contribute ideas at regular meetings of the branch (if invited by the branch executive committee) but are not allowed to participate in voting on union issues.
In case of necessity regarding staff work, if you have the credibility to be elected to the leadership agency, you must transfer union membership records to your place of residence before implementing the process of introducing candidate personnel.
Union members working in the union at their place of residence who wish to stand for election (or be nominated for candidacy) for the executive committee of the commune, ward, or township union must be approved by the commune, ward, town party committee, and immediate superior union. If a union member is a party member, the approval of the cell where he or she studies or works must be obtained.
