Regarding this issue, LawNet would like to answer as follows:
According to Clause 1, Article 3 of Resolution 96/2023/QH15, the collection of votes of confidence is the exercise of the right by the National Assembly or People's Council to supervise and evaluate the confidence level of a person holding a position elected or approved by the National Assembly or the People's Council as a basis for staff evaluation.
The process of obtaining votes of confidence at the People's Councils of provinces and districts in Vietnam is specified in Article 11 of Resolution 96/2023/QH15 as follows:
- At least 45 days before the opening date of the People's Council meeting, based on the subjects eligible for the vote of confidence specified in this Resolution, the Standing Committee of the People's Council shall consider and estimate the list of persons receiving a vote of confidence and request in writing that the person receiving a vote of confidence send a report using the form specified in the Appendix to this Resolution and a declaration of assets and income to the Standing Committee of the People's Council.
- The person receiving the vote of confidence shall send the report and declaration of assets and income to the Standing Committee of the People's Council at least 30 days before the opening date of the meeting of the People's Council.
- The Vietnam Fatherland Front Committee of the same level gathers and synthesizes the opinions and recommendations of voters and the People related to the person receiving the vote of confidence (if any) and sends them to the Standing Committee of the People's Council at least 25 days before the opening date of the People's Council meeting.
- At least 20 days before the opening date of the People's Council meeting, the Standing Committee of the People's Council shall send the report of the person receiving the vote of confidence and the report summarizing the opinions and recommendations of the voters and the people concerned to the person receiving a vote of confidence from the Vietnam Fatherland Front Committee of the same level (if any) to a delegate of the People's Council; send the contents of the opinions and recommendations of voters and people directly related to the vote of confidence (if any) compiled by the Vietnam Fatherland Front Committee of the same level to the person receiving the vote of confidence .
- In case it is necessary to clarify issues related to the person receiving the vote of confidence, at least 15 days before the opening date of the meeting of the People's Council, Delegates of the People's Council may send a written request to the Standing Committee of the People's Council to request the competent authority to verify and reply in writing.
- At least 10 days before the date of the meeting to collect the vote of confidence, Delegates of the People's Council may send a written request to the Standing Committee of the People's Council and the person receiving the vote of confidence to request that the person receiving the vote of confidence clarify the contents of the basis of the credit rating.
- At least 03 days before the date of holding the meeting to collect the vote of confidence, the person receiving the vote of confidence is responsible for sending an explanatory report (if any) on the issues mentioned in the report summarizing the opinions and recommendations of voters and people of the Vietnam Fatherland Front Committee and the opinions of the People's Council deputies to the Standing Committee of the People's Council and the People's Council deputies upon request.
- The collection of votes of confidence is carried out at the meeting of the People's Council in the following order:
+ The Standing Committee of the People's Council shall submit to the People's Council for decision the list of persons entitled to a vote of confidence;
+ Delegates of the People's Council discuss at the Delegates Group of the People's Council;
+ At the meeting to collect votes of confidence, the Standing Committee of the People's Council shall report to the People's Council the results of discussions at the Group. The session to collect votes of confidence may only be conducted when at least two-thirds of the total number of delegates to the People's Council attend;
+ The People's Council establishes a vote counting committee;
+ The People's Council takes the vote of confidence by secret ballot. The voter must clearly state the full name and position of the people receiving the vote of confidence, the levels: "high confidence", "trust", "low confidence";
+ The Vote Counting Committee reports the vote counting results;
+ The People's Council considers and approves the Resolution certifying the vote of confidence at the request of the Standing Committee of the People's Council.
