Plan for consolidation of legislative documents in 2023 of the Ministry of Home Affairs in Vietnam

Decision 33/QD-BNV was issued on January 19, 2023 on the Ministry of Home Affairs' plan for consolidation of legal documents in 2023.

Purpose and requirements of the Plan for Consolidation of Legal Documents in 2023

Purpose: Implement the consolidation of legal documents under the authority of the Minister of Home Affairs to ensure timely, compliance with the order, procedures and techniques as prescribed in the Ordinance on Consolidation of Legal Documents. year 2012.

Request:

- Reviewing and consolidating legal documents that need to be consolidated according to regulations.

- Specifying the responsibilities of the units in the consolidation of legal documents.

- Ensure the initiative and close coordination among relevant units in consolidating legal documents.

Responsibilities of units in Vietnam in the implementation of the Plan of Consolidation of Legal Documents in 2023

1. Legal Department in Vietnam to assume the prime responsibility for and coordinate with the following units:

- Monitoring, urging, and guiding units to merge legal documents under the Program on building legislative documents of the Ministry of Home Affairs in 2023 and other legal documents (if not yet merged) .

- Commenting and checking the authenticity of the draft consolidated documents implemented by the units.

- Posting the consolidated document on the National Law Database as prescribed in Article 17 of Decree 52/2015/ND-CP dated May 28, 2015 of the Government National Law Database .

- Preparing a report on the implementation of the consolidation of legal documents by the Ministry of Home Affairs at the request of competent authorities.

2. The unit in charge of drafting legislative documents, assuming the prime responsibility for, and coordinating with the Legal Department:

- Reviewing and making a list of legal documents that need to be consolidated and sent to the Legal Department for monitoring and synthesis.

- Implementing the consolidation of legal documents to ensure the accuracy of the content and consolidation techniques of the consolidated documents; sending the draft of the consolidated document to the Legal Department for comments; submitting the Ministry's leadership to sign and authenticate the consolidation document within the time specified in Clause 3, Article 6, Clause 5, Article 7 of the Ordinance on Consolidation of Legal Documents.

- Sending the consolidated document to the Legal Department for publication on the national legal database as prescribed in Article 16 of Decree 52/2015/ND-CP dated May 28, 2015 of the Government's National Law Database.

- Uploading the consolidated document on the Ministry's website and sending the consolidated document to the Official Gazette for publication, the Government Office for posting on the Government's website according to the provisions of Article 8 of the Ordinance on Consolidation of Legislative Documents.

- Handling errors in consolidated documents and correcting them (if any) according to the provisions of Article 9 of the Ordinance on Consolidation of Legal Documents.

- Preparing budget estimates, expenditure contents, and spending norms according to the provisions of Joint Circular 192/2013/TTLT-BTC-BTP dated December 13, 2013 of the Minister of Finance, the Minister of Justice regulations on estimating, management, use and finalization of state budget funds to ensure the unification of legal normative documents and legal normative legislative documents (Joint Circular 192/2013/TTLT-BTC-BTP) regarding the tasks to be implemented under this Plan.

3. Department of Planning and Finance, Office of the Ministry

- Ensuring funding for the consolidation of legal documents under the authority and responsibility of the Ministry of Home Affairs as prescribed in Joint Circular 192/2013/TTLT-BTC-BTP.

- Funding for the implementation of tasks on the consolidation of legal documents by the Ministry of Home Affairs in 2023 is deducted from the budget of the Ministry of Home Affairs and other lawful funding sources.

4. Information Center

Coordinating and supporting the management units, publicize the consolidated documents signed and authenticated by the Ministry's leaders on the Ministry's web portal.

5. Journal of State Organization

Information, propaganda, and dissemination of consolidated documents have been signed and authenticated by the Ministry's leaders.
