Technical requirements for environmental protection applied to ordinary industrial solid waste-carrying vehicles in Vietnam (Internet image)
Pursuant to Clauses 18, 19, Article 3 of the Law on Environmental Protection 2020 on waste and solid waste, then:
- Waste means any matter in a solid, liquid or gaseous form or other form which is discharged from production, business operation, service provision or living activities or from other activities.
- Solid waste means any waste in a solid form or sludge.
Pursuant to Clause 12, Article 3 of Decree 08/2022/ND-CP, industrial waste means waste generated from production, business operations and services, including hazardous waste, controlled industrial waste and normal industrial solid waste.
According to Clause 1, Article 81 of the Law on Environmental Protection 2020, normal industrial solid waste (“NISW”) shall be classified into the following groups:
- NISW reused and recycled as production materials;
- NISW in compliance with standards, technical regulations and technical guidance used in production of building materials and leveling;
- NISW subject to treatment.
In addition, according to Clause 2, Article 81 of the Law on Environmental Protection 2020, Owners of businesses, dedicated areas for production, business operation and service provision, industrial clusters and organizations that produce NISW shall classify NISW at source as prescribed in Clause 1 of Article 81 of the Law on Environmental Protection 2020; store NISW without causing environmental pollution. Unclassified NISW must be managed as the waste specified in Point c Clause 1 of Article 81 of the Law on Environmental Protection 2020.
Pursuant to Article 67 of Decree 08/2022/ND-CP, the responsibilities of normal industrial solid waste collectors and transporters include:
- Be only entitled to sign contracts for collection and transport of group of normal industrial solid waste subject to mandatory treatment as prescribed in point c clause 1 Article 81 of the LEP with waste generators after signing contracts for transfer thereof to the entities mentioned in points b and c clause 1 Article 82 of the LEP.
- Make a record on transfer of normal industrial solid waste by using the form promulgated by MONRE upon transferring the group of normal industrial solid waste subject to mandatory treatment as prescribed in point c clause 1 Article 81 of the LEP.
- Ensure that vehicles for transport, equipment for storage, transfer stations and areas for temporary storage of normal industrial solid waste satisfy the technical requirements prescribed by MONRE.
Pursuant to Article 34 of Circular 02/2022/TT-BTNMT, technical requirements for environmental protection applied to ordinary industrial solid waste-carrying vehicles in Vietnam include:
- The ordinary industrial solid waste-carrying vehicles shall meet the requirements for technical safety and environmental protection in accordance with the regulations of the Transport Law
- Ordinary industrial solid waste shall be directly stored in waste storage equipment or transport vehicles The ordinary industrial solid waste storage equipment shall be fixed or detachable equipment that are installed into the waste-carrying vehicles and meet requirements specified Clause 1, Article 33 of Circular 02/2022/TT-BTNMT.
- The ordinary industrial solid waste-carrying vehicles shall ensure that there is no drop of waste, odor and dust emission throughout transport process.
- The tarpaulin truck shall be covered with tarpaulins to avoid the sun and rain throughout the process of collecting, storing and transporting ordinary industrial solid waste.
- The ordinary industrial solid waste-carrying vehicles shall have a phrase"VẬN CHUYỂN CHẤT THẢI" on both sides of the vehicles with a height of at least 15 cm and the name, address and contact phone of the facility.
