Regarding this issue, LawNet would like to answer as follows:

1. What are the forces involved in protecting security and order at the grassroots level?

The force participating in protecting security and order at the grassroots level is a force established by local authorities on a voluntary basis by the people to support the Commune, Ward, and Town public security (hereinafter referred to as Commune-level public security) to assist the People's Committee at the same level in protecting security and order and building a movement of all people to protect national security.

(Clause 2 of Article 2 of the Law on Forces participating in protecting security and order at the grassroots level 2023)

2. Tasks of forces participating in protecting security and order at the grassroots level in Vietnam

The tasks of forces participating in protecting security and order at the grassrootss level are specified in Chapter II of the Law on Forces participating in protecting security and order at the grassroots level 2023 including:

(1) Support in understanding the situation of security and order

- Support the Commune public security to understand the situation of violations of laws on security, order, social evils, and domestic violence in the area in charge through People's sources and mass media according to the instructions of the Commune public security.

- When discovering or receiving information that violates the law on security, order, social evils, or domestic violence in the area in charge, it must be immediately reported to the Commune public security; be present at the place where the incident occurs to perform tasks according to the requests and instructions of the Commune-level public security; promptly prevent acts of infringement or threats to infringe upon the life, health, property of individuals, and property of agencies and organizations within permissible conditions and capabilities and according to the provisions of law.

(2) Support the building of a movement of all people to protect national security

- Support commune-level public security to propagate and disseminate policies and laws on security and order and build and replicate advanced models and examples in the movement of all people protecting national security.

- Mobilize people to participate in preventing, detecting, stopping, and fighting against crimes and violations of the law on security and order.

(3) Support for fire prevention, fighting, rescue, and rescue

Forces participating in protecting security and order at the grasslands level according to the requests, instructions, and assignments of the Commune-level public security, supporting civil defense forces in fire prevention, fighting, rescue, and salvage activities in their areas or other areas when requested.

(4) Support for administrative management of social order

- Support the Commune-level public security to obtain information about the activities of business establishments in investment and business sectors with security and order conditions in the area in charge; In the event of directly detecting or receiving information that violates the law, it must be immediately reported to the Commune-level public security directly managing it.

- Grasp demographic information and support commune-level public security in checking population, temporary residence, and temporary absence in the area in charge.

- Propagate and mobilize agencies, organizations, and people in the area to be responsible for declaring and handing over fireworks, weapons, explosives, and support tools according to regulations.

- In the process of performing the tasks specified in Clauses 1, 2, and 3 of this Article, if a violation of the law is discovered, it must be immediately reported to the Commune-level public security who directly manage and assist the Commune-level public security to promptly prevent it.

(5) Support advocacy and education for people who have committed illegal acts and are residing at the facility

Support the Commune-level public security to mobilize and educate the following people living in the area to well comply with the Party's guidelines and policies, and the State's laws:

- People who have completed their prison sentence; illegal drug users, voluntary drug addicts at home and in the community; people who have completed the decision to be sent to a reformatory, sent to a compulsory education facility, or sent to a mandatory detoxification facility; people on conditional release from prison;

- People who are subject to measures prohibiting them from leaving their place of residence; people who are guaranteed money as security; People sentenced to prison but have not yet had a decision to execute the sentence or have had a decision to execute the sentence but are on bail or have their sentence postponed or temporarily suspended; People sentenced to prison with suspended sentences are currently on probation; people who are serving sentences of non-custodial reform, ban on residence, ban on holding positions, ban on practicing certain professions or doing certain jobs, deprivation of certain civil rights, probation; people who have been released from prison before their term of imprisonment are on probation; people who have completed serving the Court's sentence have not had their criminal records erased;

- People who are being subjected to educational measures in communes, wards, towns, or family management; people who must comply with the decision to apply the measure of being sent to a compulsory education facility, being sent to a mandatory detoxification facility, or being sent to a reformatory but are being postponed or temporarily suspended from complying with the decision; the person being managed during the process of considering and deciding to apply the measure of sending to a compulsory education facility, sending to a mandatory detoxification facility, sending to a reformatory; people who commit acts of domestic violence.

(6) Support patrols to ensure security, order, and traffic safety; perform the task of protecting security and order when mobilized

- Support commune-level public security to patrol, prevent, and detect violations of the law on security and order in their area of responsibility.

- Support commune-level public security to guide, classify traffic, and resolve traffic jams when mobilized.

- When performing the tasks specified in Clauses 1 and 2 of this Article, if an incident related to security and order is detected, the forces participating in protecting security and order at the grassroots level will provide support or according to the instructions of the Commune public security, functional forces to protect the scene, security, and order.

- In cases of complicated security and order situations outside the area of responsibility, forces participating in protecting security and order at the grassroots level can be mobilized by competent authorities to perform the task of protecting security and order. The use of forces to protect security and order at the groundswell level in cases of mobilization is carried out in accordance with relevant laws.

Law on Forces participating in protecting security and order at the grassroots level 2023 takes effect on July 1, 2024.
