Regarding this issue, LawNet would like to answer as follows:

1. Tasks and powers of village heads and neighborhood heads in Vietnam

Duties and powers of Village Heads, neighborhood heads according to Article 10 of Circular 04/2012/TT-BNV (amended in Circular 14/2018/TT-BNV) are as follows:

* Tasks:

- Convene and chair meetings of villages and neighborhoods; organize the implementation of the work within the village, population groups have been discussed and decided by the people; ensure the activities of villages and residential groups as prescribed in Article 5 of Circular 04/2012/TT-BNV (amended in Circular 14/2018/TT-BNV):

+ Communities in villages and neighborhoods discuss policies and levels of contributions to the construction of infrastructure and public welfare works within communes, villages, and residential groups, fully or partially contributed by the people and self-managed within the population community in accordance with the provisions of law.

+ The community participates in the discussion and votes for the competent authorities to decide; consult before the competent authority decides on the work of the village, population group, and commune level in accordance with the Ordinance on Implementation of Democracy in Communes, Wards, and Townships.

+ Formulate and implement village conventions; participate in self-management in maintaining security, order, social safety, and environmental sanitation; preserve and promote good cultural traditions in the locality, prevent and combat social evils.

+ To implement the guidelines and guidelines of the Party, policies, and laws of the State; participate in and respond to movements and campaigns launched by the Party, State, Fatherland Front, and socio-political organizations.

+ Elect, relieve from duty, and remove from office the village head and the head of the population group.

- Mobilize and organize the people to well implement democracy at the grassroots level and at the village conventions and conventions already approved by competent agencies;

- Gather, reflect, and request the commune-level authorities to settle the legitimate recommendations and aspirations of the people in the villages and neighborhoods. To promptly report to the commune-level People's Committees on violations of the law in villages and neighborhoods;

- Make a record of the results discussed by the people of the village and the street population group and decide directly the work of the village or residential group; make minutes on the results discussed and voted on by the people of the village and the street population groups on the work within the scope of the commune; report the results to the Chairman of the commune-level People's Committee;

- Coordinate with the Front's Working Committee and socio-political organizations in villages and neighborhoods to mobilize people to participate in the implementation of movements and campaigns launched by these organizations;

- In the first six months of the year and at the end of the year, the results of the work must be reported to the village meeting, the population group.

* Power:

- Be able to sign contracts on the construction of works funded by the people in the villages and neighborhoods, which have been approved by the village meetings and residential groups, and ensure relevant regulations from the authorities at all levels;

- Be assigned the task of solving work to the Deputy Head of the village and the Deputy Head of the residential group; be invited by the commune-level government to meet and provide information and documents related to the management and operation of villages and neighborhoods; receive training in the organization and operation of villages and neighborhoods.

2. Policies for village heads, neighborhood heads and village deputy heads, neighborhood deputy heads in Vietnam

Policies for village heads, neighborhood heads and village deputy heads, neighborhood deputy heads according to Article 13 of Circular 04/2012/TT-BNV are as follows:

- Each village head or neighborhood head is a person in charge of part-time job in a village or neighborhood and eligible for monthly allowances; the amount of allowances shall be decided by the People’s Council of province as prescribed.

- Each village head, neighborhood head and village deputy head, neighborhood deputy head is provided with training courses in necessary knowledge and skills;

He/she shall be praised or rewarded upon excellent performance of tasks, or dismissed, discharged or liable for penalties, depending on the nature and extent of violations, upon failure to fulfill tasks, violations or failure to gain the people's trust.
