1. Position and functions of the Institute for Legal Strategy and Science in Vietnam

The Institute for Legal Strategy and Science is a public service unit under the Ministry of Justice with the function of researching strategies and policies on law construction and enforcement and other areas of work under the Ministry's state management scope, contributing to implementing legal reform, administrative reform, judicial reform, and building a socialist rule-of-law state in Vietnam; managing scientific research activities of the Ministry, and acting as a focal point for legal scientific information under the Ministry's state management scope.

The Institute for Legal Strategy and Science (hereinafter referred to as the Institute) is under the direct management and direction of the Minister of Justice and is under the state management of science by the Minister of Science and Technology.

The Institute is a unit with legal status, headquartered in Hanoi, with its own seal and account according to the provisions of the law.

The Institute's international transaction name is Institute for Legal Strategy and Science (abbreviated as ILSS).

2. Tasks and powers of the Institute for Legal Strategy and Science in Vietnam

The Institute for Legal Strategy and Science has the following tasks and powers:

- Develop and submit to the Minister a strategy for developing the judicial sector, plans, programs, schemes, projects, and draft documents on the management of scientific research activities of the Ministry of Justice to promulgate according to authority or submit to a competent authority for promulgation; Participate in developing, appraising, and commenting on projects and draft documents as assigned by Ministry leaders or at the request of units under the Ministry or units under other relevant ministries and branches; Provide scientific opinions on major and important issues in specialized fields of the Ministry.

- Research theories, summarize practice and domestic and international experience, and propose and act as a focal point to monitor the implementation of policies and orientations on justice and law in the socio-economic development strategy; on building and perfecting socialist-oriented market economic institutions; on building and perfecting the Vietnamese socialist rule-of-law state under the Ministry's state management scope.

- Develop and submit to the Minister the Institute's long-term, 5-year, annual work plan; participate in building strategies, planning, long-term, 5-year, and annual development plans of the judicial sector.

- Organize the implementation of strategies, planning, plans, programs, schemes, projects and other documents within the scope of functions and tasks of the Institute.

- Regarding the organization of scientific tasks:

+ Organize the implementation of scientific tasks to determine vision and provide scientific and practical arguments for building strategies, planning, plans, mechanisms, policies, programs, schemes, projects, models, and development solutions for the Ministry;

+ Carry out research on international experience and strategic forecast research on development trends in the areas under the Ministry's management; Organize or participate in domestic and international scientific research in the Institute's research fields according to the provisions of the law and the Ministry's regulations on the management of foreign affairs activities;

+ Organize research, evaluate and summarize practices, and assess economic and social impacts to propose the development, amendment, and supplementation of legal documents in the fields under the Ministry's state management when ordering is required;

+ Organize research and participate in building management mechanisms and professional standards in fields under the Ministry's state management;

+ Research and propose scientific solutions to solve difficult, complex, and entangled problems in fields under the state management of the Ministry and the judicial sector; Organize research on issues arising from specific fields of law and other scientific issues according to the requirements of the Ministry and the needs of society.

- Regarding the management of legal scientific research:

+ Develop and submit to the Minister long-term, 5-year, and annual scientific research programs and plans of the Ministry;

+ Organize consulting, selection, and direct assignment to organizations and individuals in charge of implementing scientific tasks at ministerial and grassroots levels according to regulations; Sign contracts to implement scientific tasks according to legal regulations and the decentralization and authorization of the Minister;

+ Organize appraisal, evaluation, and acceptance of the results of the implementation of scientific tasks and other scientific tasks assigned or requested by competent agencies and organizations;

+ Register and store the results of scientific tasks using part or all of the state budget and other resources of the Ministry according to the law; Process and update information about ongoing scientific tasks; Monitor the application of the research results of approved scientific tasks;

+ Support registration and protection of intellectual property rights; publish scientific research results; recommend commendation and consideration for scientific awards;

+ Propose to the Minister orientations for exploiting and using the Ministry's scientific research results; Apply the results of legal scientific research under the Ministry's management;

+ Participate in building, collecting, processing, updating, and integrating legal science data under the Ministry's management into the National Database on Science and Technology according to the provisions of law;

+ Develop plans, make estimates, and allocate the state budget for the Ministry's science and technology activities; manage and use science and technology funding from the state budget; Evaluate the content and budget of scientific tasks.

- Regarding legal science information work and library work of the Ministry:

+ Compile and publish a special issue of legal scientific information and other publications based on research results and operational results in the fields under the Ministry's state management;

+ Organize the collection, update, processing, and storage of documents, materials, data, and figures to create and develop legal scientific information sources; research, analyze, and synthesize legal scientific information for forecasting, policy planning, leadership, management, and scientific research;

+ Build, manage, and organize the exploitation of the Ministry's library to serve the activities of the Ministry and the Justice sector;

+ Build, manage, and exploit the database of legal scientific documents and materials to serve research activities and legal scientific services; Update information on the historical development of the Ministry and the Justice sector; Providing, exchanging, and sharing legal scientific information sources.

- Carry out the tasks of the standing agency of the Ministry's Scientific Council.

- Organize and implement the application of information technology and digital transformation in fields within the scope of functions and tasks of the Institute; Manage, operate, and update the content of the Institute's website.

- Carry out inspection work, participate in inspections, and resolve petitions, complaints, and denunciations in areas within the scope of the functions and tasks of the Institute according to legal regulations and the decentralization of the Ministry.

- Carry out preliminary and final reviews, reporting, and statistics on fields within the scope of the functions and tasks of the Institute.

- Carry out international cooperation activities in the fields within the scope of the functions and tasks of the Institute according to legal regulations and the decentralization of the Ministry.

- Carry out policy communication, dissemination, and legal education; participate in training and fostering civil servants and public employees in the fields falling within the functions and tasks of the Institute according to legal regulations; and decentralize the Ministry.

- Implement administrative and judicial reform; clerical work; storage; protection of state secrets; and network security; prevent and combat corruption, waste, and misconduct; and handle violations of the law in the fields falling within the functions and tasks of the Institute according to legal regulations and decentralization of the Ministry.

- Implement financial and accounting regimes; manage and use public assets according to the provisions of the law and the Ministry of Justice.

- Carry out emulation, reward, and management of the Institute's staff and employees according to legal regulations and decentralization of the Ministry.

- Perform other tasks assigned by the Minister.
