The Inspectorate of the Ministry of Labor, Invalids and Social Affairs of Vietnam is an agency under the Ministry of Labor, Invalids and Social Affairs, with specific tasks and powers within its authority.

Position and function of the Inspectorate of the Ministry of Labor, Invalids, and Social Affairs of Vietnam

The Inspectorate of the Ministry of Labor, Invalids, and Social Affairs of Vietnam (hereinafter referred to as the Inspectorate) is an agency under the Ministry of Labor, Invalids, and Social Affairs. It functions to assist the Minister in state management of inspection work, citizen reception, complaint and denunciation resolution, and anti-corruption and negativity prevention; conduct administrative inspections of agencies, organizations, and individuals under the Ministry's management; conduct specialized inspections in fields within the Ministry's state management according to the Minister's regulations, ensuring no overlap with the inspection functions of other agencies within the Ministry; and carry out tasks related to citizen reception, complaint and denunciation resolution, and anti-corruption and negativity prevention as prescribed by law.

The Inspectorate is under the direction and management of the Minister and under the professional inspection guidance of the Government Inspectorate of Vietnam.

The Inspectorate has its international trade name in English as Ministry Inspectorate, abbreviated as MI.

Tasks and powers of the Inspectorate of the Ministry of Labor, Invalids, and Social Affairs of Vietnam

Specifically, Article 2 of the Decision 968/QD-BLDTBXH of 2024 stipulates the tasks and powers of the Inspectorate of the Ministry of Labor, Invalids, and Social Affairs of Vietnam as follows:

- Preside or participate in drafting legal normative documents as assigned by the Minister; recommend competent authorities to amend, supplement, or promulgate legal normative documents in line with state management requirements in the field of labor, people with meritorious services, and society.

- Preside over the development of the Ministry's inspection plan; guide the drafting of inspection plans by agencies performing inspection functions under the Ministry to aggregate into the Ministry's inspection plan for the Minister to promulgate.

- Organize the implementation of inspection plans under the responsibility of the Inspectorate; guide, monitor, urge, and inspect the implementation of inspection plans under the responsibility of agencies performing inspection functions under the Ministry.

- Inspect the compliance with specialized laws, professional and technical regulations, and management rules within the Ministry's management scope:

+ Inspect compliance with labor laws; employment; social insurance (compulsory social insurance, voluntary social insurance), unemployment insurance, labor accident and occupational disease insurance (except for the content of inspecting social insurance, health insurance, and unemployment insurance contributions); inspect compliance with legal regulations on employers' obligations to participate in health insurance and subjects under management of the Ministry of Labor, Invalids, and Social Affairs as stipulated in the Law on Health Insurance;

+ Inspect compliance with laws on preferential treatment for people with meritorious services to the revolution;

+ Inspect compliance with laws on children within the scope, authority, and responsibilities of the Ministry;

+ Inspect compliance with laws on poverty reduction and social assistance;

+ Inspect compliance with laws on social evils prevention;

+ Inspect compliance with gender equality laws within the Ministry's authority and responsibilities;

+ Inspect compliance with other legal regulations in the fields of labor, people with meritorious services, and society as assigned by the Minister.

- Inspect the implementation of policies, laws, Tasks, and powers by agencies, organizations, and individuals under the Minister's management; inspect public service; inspect the implementation of professional activities by public employees within the Ministry's management according to legal regulations.

- Inspect issues related to multiple fields within the Ministry's state management scope.

- Conduct unexpected inspections, inspect other cases, and participate in inspection and examination teams of the State, the Ministry, and related sectors as assigned by the Minister.

- Verify the accuracy and legality of inspection conclusions and post-inspection decisions by agencies performing inspection functions under the Ministry; make post-inspection decisions by the Chairman of the provincial People's Committee for cases within the Ministry's state management scope when necessary as prescribed by law.

- Re-inspect cases where inspection conclusions have been made by agencies performing inspection functions under the Ministry; cases under the Ministry's state management scope that have been concluded by the Department's Inspectorate but show signs of legal violations through handling complaints, denunciations, recommendations, and feedback as prescribed by law.

- Investigate labor accidents and violations of safety and labor hygiene standards; participate in developing and guiding the application of national technical standards on labor safety and hygiene.

- Assist the Minister in state management of citizen reception work, handle complaints and denunciations within the Ministry's management scope; conduct citizen reception, process complaints and denunciations in the field of labor, people with meritorious services, and society as prescribed by law.

- Assist the Minister in state management of anti-corruption and negativity prevention work; perform anti-corruption and negativity prevention tasks according to anti-corruption laws within the Ministry's state management scope.

- Provide professional guidance for specialized inspections to agencies performing inspection functions under the Ministry, the Inspectorate of the Department of Labor, Invalids, and Social Affairs.

- Organize training and retraining on specialized inspection; anti-corruption and negativity prevention, complaint and denunciation resolution; and citizen reception for inspectors, officials assigned to perform specialized inspection tasks, and officials conducting inspection work under the Ministry, sector of Labor, Invalids, and Social Affairs.

- Require the heads of agencies performing inspection functions under the Ministry to report on inspection work; aggregate and report inspection results within the Ministry's state management scope.

- Monitor, urge, and inspect the implementation of Inspectorate conclusions and recommendations, post-inspection decision handling by the Minister.

- Conduct scientific research; participate in disseminating and educating legal knowledge as assigned by the Ministry.

- Synthesize and report to the Minister and the Chief Inspector the Government of Vietnam on inspection work, citizen reception, document and letter handling, complaint and denunciation resolution, anti-corruption and negativity prevention within the Ministry's state management scope as prescribed; summarize experiences, professional inspections in labor, people with meritorious services, and social fields.

- Carry out international cooperation and integration as assigned by the Ministry.

- Manage officials, employees, facilities, finance, and assets according to legal regulations and the Ministry's management decentralization.

- Perform other tasks as prescribed by law and assigned by the Ministry.
