Regarding this matter, LawNet would like to answer as follows: 

1. Position and functions of the Inspectorate of the Ministry of Agriculture and Rural Development in Vietnam

- The Inspectorate of the Ministry of Agriculture and Rural Development is an agency under the Ministry of Agriculture and Rural Development, assisting the Minister in state management of inspection work, citizen reception, settlement of complaints, denunciations, and anti-corruption and misconduct; performing administrative inspection tasks for agencies, organizations, and individuals under the management authority of the Ministry; performing specialized inspection tasks in fields within the scope of state management of the Ministry as prescribed by the Minister, ensuring no overlap with the functions and tasks of the Departments under the Ministry entrusted with specialized inspection functions; performing citizen reception, settlement of complaints, denunciations, and anti-corruption and misconduct as prescribed by law.

- The Inspectorate of the Ministry of Agriculture and Rural Development of Vietnam (hereinafter referred to as the Inspectorate) is under the direction and management of the Minister and is guided in professional tasks by the Government Inspectorate.

- The Inspectorate has legal status, a seal, its own account, and operating funds as prescribed by law.

- The headquarters of the Inspectorate is located in Hanoi.

2. Tasks and powers of the Inspectorate of the Ministry of Agriculture and Rural Development in Vietnam

- Provide advice, draft documents for the Minister or competent authorities to issue legal documents on inspection, citizen reception, settlement of complaints, denunciations, anti-corruption and misconduct within the scope of the Ministry's management, and other related documents as assigned by the Minister.

- Consolidate and submit to the Minister inspection programs, plans, settlement of complaints, denunciations, anti-corruption and misconduct, and organize the implementation after being approved by the Minister.

- Provide guidance, inspection, and organization of the implementation of legal documents, strategies, orientations of approved programs on inspection, citizen reception, settlement of complaints, denunciations, and anti-corruption and misconduct; provide information, disseminate, and popularize laws on inspection, citizen reception, settlement of complaints, denunciations, and anti-corruption and misconduct to agencies, organizations, and units under the Ministry.

- Chair and coordinate with relevant agencies and units to organize training, professional development in inspection, citizen reception, settlement of complaints, denunciations, anti-corruption and misconduct as prescribed.

- Regarding inspection, examination:

+ Provide advice, draft documents for the Minister to issue and guide the implementation of regulations on organization, activities of inspection under the Ministry;

+ Develop draft inspection plans of the Ministry, guide the development of draft inspection plans of the Departments under the Ministry entrusted with specialized inspection functions for consolidation into the Ministry's inspection plan to be submitted to the Minister for issuance;

+ Organize the implementation of the Ministry's inspection plan; monitor, urge, and inspect the implementation of the inspection plan of the Departments under the Ministry entrusted with specialized inspection functions;

+ Administrative inspection of agencies, organizations, and individuals under the management authority of the Minister; specialized inspection in fields within the scope of state management of the Ministry, except for the fields delegated to the Departments under the Ministry entrusted with specialized inspection functions as prescribed;

+ Specialized inspection on content related to multiple fields within the scope of state management of the Ministry; inspection of state-owned enterprises in compliance with laws, compliance with decisions of owners, compliance with specialized legal provisions, regulations on professional-technical, sector management rules in fields within the scope of state management of the Ministry;

+ Re-inspection of cases that have been concluded by the Departments under the Ministry entrusted with specialized inspection functions; cases within the scope of state management of the Ministry that have been concluded by the Provincial Inspectorate but found to have signs of violating laws through consideration, handling of complaints, denunciations, recommendations, and reflections;

+ Verify the accuracy and legality of inspection conclusions of the Departments under the Ministry entrusted with specialized inspection functions and decisions on post-inspection handling by the Chairman of the Provincial People's Committee regarding cases within the scope of state management of the Ministry when necessary;

+ Inspect the performance of tasks, delegated powers, and compliance with policies, laws of agencies, organizations, and individuals within the scope of state management of the Ministry when assigned;

+ Direct the inspection work and provide professional guidance on inspection to the Departments under the Ministry entrusted with specialized inspection functions and the Provincial Inspectorate of Agriculture and Rural Development;

+ Inspect and examine other contents as assigned by the Minister or as directed by the Government Inspectorate.

- Regarding citizen reception, settlement of complaints, and denunciations:

+ Perform the task of directly receiving citizens of the Ministry and organizations, processing complaints, denunciations, recommendations, and reflections according to regulations;

+ Organize inspections, verifications, recommend solutions for complaints, and handle denunciations within the jurisdiction of the Minister when assigned.

- Regarding anti-corruption and misconduct:

+ Advise the Minister on directing, inspecting, urging, and guiding agencies, organizations, units, and individuals under the management authority of the Ministry, building and organizing the implementation of work on anti-corruption and misconduct and other related legal regulations;

+ Advise and assist the Minister in controlling the assets and income of individuals who have the obligation to declare their work at agencies, organizations, units, and state-owned enterprises under the management scope of the Ministry, as prescribed.

- Assist the Minister in monitoring, inspecting, and urging agencies, organizations, and units under the management authority of the Ministry in citizen reception, settlement of complaints, denunciations within their jurisdiction, and implementing conclusions, recommendations of the Ministry Inspectorate, and inspection decisions of the Minister.

- Coordinate with the Inspectorates of other ministries, central authorities, inspectorate agencies at all levels, and relevant agencies, organizations, and units in the process of implementing inspection work, citizen reception, settlement of complaints, denunciations, anti-corruption and misconduct.

- Consolidate and report to the Minister, the Government Inspectorate, and relevant agencies on inspection work, citizen reception, settlement of complaints, denunciations, anti-corruption and misconduct as prescribed.

- Advise the Minister on managing and issuing inspector cards for inspectorate officials under the management authority of the Ministry, specialized inspector cards for civil servants assigned tasks of specialized inspection at the Departments under the Ministry entrusted with specialized inspection functions.

- Implement administrative reform according to the program, plan, administrative reform projects, apply information technology, and digital transformation of the Ministry.

- Manage organizational structure, staffing; officials, and employees; implement salary regimes and regimes, policies of remuneration, commendation, and discipline for officials, employees within the management scope of the Ministry Inspectorate according to the management hierarchy of the Ministry and regulations of the law.

- Manage finance, assigned assets, and organize the implementation of allocated budgets as prescribed by law.

- Perform other tasks assigned by the Minister as prescribed by law.
