Regarding this issue, LawNet would like to answer as follows:

1. Higher Education Department. is an agency under which Ministry in Vietnam?

According to Article 17 of Decision 4668/QD-BGDDT in 2022, the Higher Education Department. is a unit under the Ministry of Education and Training, performing the function of advising and assisting the Minister in the state management of higher education, pedagogical colleges, and intermediate pedagogical schools.

2. Tasks and powers of the Higher Education Department in Vietnam

Specifically, in Article 18 of Decision 4668/QD-BGDDT in 2022, the tasks and powers of the Higher Education Department in Vietnam are as follows:

(1) Regarding recruitment and training

- Advise and develop enrollment regulations (including for candidates and pre-university students transferring to universities),
Regulations on training at the pedagogical college level, the degrees of higher education in the form of formal education, work-by-study and distance training, joint training, and joint training with domestic and foreign countries;

- Advise and develop regulations on enrollment targets; stipulate the conditions, order, and procedures for opening a training major or registering for activities at the pedagogical college level; stipulate the compilation, selection, appraisal, approval, and use of teaching materials and curricula at the higher education and pedagogical college levels;

Regulations on the threshold to ensure the quality of input for the teacher training industry and the health sector with a practicing certificate; organizing the development of programs and compiling common textbooks for compulsory subjects; fostering teachers of political theory subjects as prescribed;

- Advise on the decision on suspension of enrollment, suspension of training activities, revocation of the decision on permitting training for training majors of higher education levels, or registration for activities at the college level of pedagogy, the textbooks and teaching materials do not meet the quality requirements as prescribed;

- Advise on the implementation of Vietnam's national qualification framework; make a list of statistics on training majors in higher education and teacher training colleges.

(2) Regarding the quality assurance of higher education and pedagogical colleges

- Implement regulations, criteria, standards, and requirements on standards of educational institutions, standards of training programs at higher education institutions and pedagogical colleges;

- Advise and manage the operation of higher education institutions, pedagogical colleges on conditions to ensure training quality (lecturers, managers; facilities; finance); training results; employment situation of students after graduation;

- Advise on the management of activities of higher education institutions with foreign elements and foreign-invested higher education institutions in Vietnam.

(3) Operational management of higher education institutions and pedagogical colleges

- Assume the prime responsibility for advising and assisting the Minister to submit to the Prime Minister for approval the master plan on the network of higher education and pedagogical institutions;

- Advise on the implementation of standards and regulations of higher education institutions and teacher training institutions; the Charter of the College of Pedagogy; university autonomy policies; human resource training policies for key economic regions, training according to the user's address, and for the Northwest, Central Highlands, Southwest, and other disadvantaged regions;

- Act as a focal point for the appraisal of conditions and decisions on permission and suspension of educational activities for higher education institutions and pedagogical colleges according to its competence and provisions of law.
