Regarding this issue, LawNet would like to answer as follows:

1. Tasks and powers of the Department of Technical Infrastructure in Vietnam

The tasks and powers of the Department of Technical Infrastructure are specified in Article 2 of Decision 1155/QD-BXD 2022, including:

- Develop for the Ministry to submit to competent authorities for approval orientations, strategies, projects, national programs on technical infrastructure development, national targets in the field of technical infrastructure in the task of socio-economic development of the country in each stage, and organize implementation after approval.

- Preside over organizing the appraisal of plans in the field of technical infrastructure of centrally run cities that are special urban areas for the Ministry to submit to the Prime Minister for approval; research, draft, and submit to the Minister a written comment on specialized technical infrastructure planning projects for centrally run cities that are grade I urban areas proposed by the Provincial People's Committee to the Ministry of Construction for comments according to regulations.

- Guide the development of technical infrastructure development plans according to the orientation of technical infrastructure development, regional planning, provincial planning, urban planning, and rural planning; and technical infrastructure construction investment projects as assigned by the Prime Minister to the Ministry of Construction.

- Be developed for the Ministry to submit to the competent authority for promulgation or for the Ministry to promulgate according to the authority of mechanisms, policies, and regulations on development, operation management, exploitation, use, handover of technical infrastructure systems, and provision of technical infrastructure services.

- Manage technical infrastructure services according to the provisions of the law; provide guidance on technical processes, cost planning and management, and methods for determining technical infrastructure service prices.

- Guide and inspect clean water business activities and ensure safe water supply; business activities of managing and operating cremation facilities.

- Develop for the Ministry to submit to competent authorities for promulgation or for the Ministry to promulgate according to its authority technical regulations and standards for the construction of urban transport infrastructure; regulate the decentralization and classification of urban roads; Develop and submit to competent authorities for promulgation of national standards for urban road construction.

- Be developed for the Ministry to submit to competent authorities for promulgation or for the Ministry to issue according to prescribed authority to assess the suitability and ability to meet technical infrastructure for construction investment projects.

- Guide, monitor, and inspect the implementation of legal regulations on technical infrastructure.

- Regarding other tasks in the field of technical infrastructure:

+ Monitor, synthesize, evaluate, and report on the management and development of technical infrastructure nationwide; Organize the construction and management of database systems, providing information about technical infrastructure;

+ Research and develop for the Ministry to submit to competent authorities for promulgation or for the Ministry to promulgate according to its authority mechanisms and policies to encourage the development of public services in the field of technical infrastructure; Guide and inspect organizations providing public services in the field of technical infrastructure to operate in accordance with the law;

+ Preside and coordinate with relevant units to organize the appraisal and verification of construction investment projects and the economic and technical reports of technical infrastructure projects;

+ Guide and inspect localities in construction investment activities and effectively manage and exploit the system of technical infrastructure works;

+ Preside and coordinate with relevant units to research and draft documents to submit to the Ministry of comments on investment projects to build technical infrastructure projects as ministries, branches, and localities requested the Ministry of Construction to provide comments according to the provisions of law;

+ Implement cooperation with domestic and foreign organizations and individuals in the field of technical infrastructure; Organizing consulting on construction activities, promoting construction investment, and developing technical infrastructure systems; Organize the mobilization, exploitation, and coordination of domestic and foreign resources for investment in the construction and development of the national technical infrastructure system as assigned by the Minister;

+ Guide and support local authorities in coordinating and managing the implementation of technical infrastructure development investment projects as assigned by the Minister. Organize and deploy pilot projects, manage investment projects, technical assistance projects, or technical infrastructure development programs at national, inter-regional, and regional levels because the Ministry of Construction is the managing agency or investor as assigned by the Minister;

+ Organize research on scientific and technological topics, economic and environmental projects, research and application of scientific and technological advances, and technology transfer in the field of technical infrastructure. Build, manage, and develop specialized laboratories in the field of technical infrastructure;

+ Organize training and fostering activities to improve capacity; national and international scientific forums; conferences; and seminars in the field of technical infrastructure.

- Manage organizational structure and payroll; implement salary regimes and other policies; and provide emulation, commendation, and discipline for officials, civil servants, public employees, and contract workers under the management of the Department according to the provisions of the law and the Ministry of Construction.

- Manage finances, assign assets, and organize the implementation of the allocated state budget; manage revenue-generating activities according to the provisions of the law and the Ministry of Construction.

- The Director of the Department of Technical Infrastructure has the right to:

+ Request agencies, units, and organizations operating in the areas of state management of the Ministry and localities to provide necessary data and documents to serve the implementation of the Department's work areas;

+ Sign a number of administrative, professional, and technical guidance documents in the name of the Director of the Department and use the Department's seal in accordance with the law;

+ Be authorized by the Minister to sign a number of documents on the Department's work areas according to the provisions of the Working Regulations of the Ministry of Construction.

- Perform other tasks and powers assigned by the Minister.

2. Leaders of the Department of Technical Infrastructure in Vietnam

- The Department of Technical Infrastructure has a Director and a number of Deputy Directors;

- The Director and Deputy Directors are appointed, dismissed, and dismissed by the Minister of Construction according to the regulations of the Party, the law, and the Ministry of Construction;

- Based on the functions, tasks, powers, and organizational structure of the Department of Technical Infrastructure, the Director is responsible for planning work for each stage and determining staffing needs; developing and promulgating working regulations of the Department; regulating the functions, tasks, powers, and organizational structure of affiliated units; Clearly define the authority and responsibility of each unit and individual in the Department and report to the Minister;

- The Director is responsible before the Minister and the law for all activities of the Department; the Deputy Director is responsible to the Director and the law for the assigned field of work.
