The Department of Overseas Labor is an unit under the Ministry of Labor - Invalids and Social Affairs, with the function of advising and assisting the Minister in implementing the state management function in the field of Vietnamese guest workers; managing the state's public service providers that send workers to work abroad in accordance with the law.
The international trading name in English is the Department of Overseas Labor, abbreviated as DOLAB.
(Article 1 of Decision 398/QD-BLDTBXH in 2024)
(1) Research, develop, and submit to the Ministry the following:
- Draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees of the Government, decisions of the Prime Minister, and resolutions, projects, and plans as assigned by the Ministry regarding Vietnamese guest workers in accordance with the law;
- Long-term, medium-term, and annual strategies, programs, projects, and plans regarding Vietnamese guest workers under the Ministry's management;
- Draft circulars and other documents on state management in the field of Vietnamese guest workers under the Ministry's management;
- Agreements, negotiation contents in the field of Vietnamese guest workers between Vietnam and countries, territories, and international organizations;
- Regulations, policies for officials, public employees, employees working in the field of Vietnamese guest workers, and mechanisms, policies regarding Vietnamese workers going to work abroad under contracts;
- Documents proposing banks to receive deposit refunds for service enterprises and Vietnamese enterprises that send Vietnamese workers abroad for training, improving qualifications, and skills.
(2) Assist the Ministry in implementing legal information, dissemination, and education activities regarding Vietnamese guest workers.
(3) Assist the Ministry in providing guidance, organizing, and inspecting the implementation of legal provisions regarding Vietnamese guest workers.
(4) Introduce and promote the labor resources, Vietnam's labor supply capacity to the international labor market.
(5) Advise and assist the Ministry in researching, orienting, and promoting the expansion, stability, and development of the international labor market.
(6) Assist the Ministry in deciding on the issuance, renewal, reissuance, adjustment of information, and revocation of operating licenses for service enterprises sending Vietnamese workers to work abroad in accordance with the law.
(7) Organize and guide the registration of contracts between enterprises and Vietnamese workers directly entering into labor contracts to work abroad; register labor source preparation; report on sending Vietnamese workers to work abroad as prescribed by law; sign documents in response to related enterprises, agencies, organizations, and individuals.
(8) Take the lead in assisting the Ministry in developing and guiding the implementation of plans to prepare Vietnamese workers to work abroad; manage educational activities for Vietnamese workers before going to work abroad in accordance with the law.
(9) Assist the Ministry in directing, organizing the management, protecting the legal rights and interests of Vietnamese workers working abroad under contracts in accordance with the law.
(10) Conduct scientific research; participate in training, retraining officials, civil servants, employees, and workers in professional and vocational fields related to Vietnamese guest workers as assigned by the Ministry.
(11) Collect, manage, and use revenue from activities sending Vietnamese guest workers in accordance with the law.
(12) Perform the function of sectoral inspection in the field of Vietnamese guest workers as prescribed by law.
(13) Provide advice, submit to the Ministry guidelines on the implementation of relevant contents related to the deposit of service enterprises, Vietnamese enterprises sending Vietnamese workers abroad for training, improving qualifications, and skills, and Vietnamese guest workers as prescribed by law.
(14) Provide guidance and organize the implementation of information, reporting, and statistical work according to the law; summarize, evaluate, and replicate advanced models and exemplary practices in the field of Vietnamese nationals working abroad under contracts. Manage Vietnamese guest workers through a unique identification code integrated into the common database system of Vietnamese guest workers as assigned by the Ministry.
(15) Provide guidance and technical assistance to the Ministry's representatives managing Vietnamese labor working at diplomatic missions and Vietnamese agencies abroad.
(16) Assist the Ministry in managing non-governmental organizations and associations operating in the assigned field according to the law.
(17) Carry out international cooperation and integration in the field of Vietnamese guest workers as assigned by the Ministry.
(18) Assist the Ministry in directly managing and directing the Operations Agency of the Overseas Employment Support Fund and coordinate with relevant units to provide guidance and technical assistance to the Overseas Employment Support Fund according to the law.
(19) Assist the Ministry in guiding and organizing the implementation of state management over public career services that send workers to work abroad according to the law.
(20) Manage officials, workers; facilities, finances, and assets according to the law and delegation of the Ministry.
(21) Perform other tasks as prescribed by law and assigned by the Minister.
