Regarding this issue, LawNet would like to answer as follows:

1. Under which ministry are Border and Mountain Trade Department working?

The Border and Mountain Trade Department is an organization under the Ministry of Industry and Trade, with the function of advising and assisting the Minister in state management of border trade development, mountainous, island and ethnic minority areas as prescribed by law and as assigned by the Minister.

2. Tasks and powers of Border and Mountain Trade Department in Vietnam

Tasks and powers of the Border and Mountain Trade Department in Vietnam include:

- Formulate and submit to the Minister for approval, promulgate or submit to competent authorities for approval; and promulgate mechanisms, policies, strategies, programs, plannings and legislative documents on the development of border trade, mountainous, island, and ethnic minority areas.

- Assume the prime responsibility for developing and submitting to the Minister of Industry and Trade for approval and promulgation:

+ Regulations on mechanisms and policies on trade activities, cross-border goods exchange, border-gate economic zones (commodities, traders, operating mechanisms)
and services to support trade in border, mountainous, island, and ethnic minority areas.

List of goods purchased, sold, and exchanged by border residents in each period and region;

+ To assume the prime responsibility for, and coordinate with relevant units in, formulating planning schemes, programs, and mechanisms for the development of economic cooperation zones in border provinces; drafting international treaties and agreements on border trade between Vietnam and China, Vietnam with Laos, and Vietnam with Cambodia;

+ Regulations on the organization, management, and development model of border trade in mountainous, island, and ethnic minority areas (including: markets, border markets, trade centers, border-gate economic zones, and related commercial service establishments, ...) as assigned by the Minister;

+ Regulations on methods of goods exchange transactions, border trade, mountainous areas, islands, and ethnic minority areas under the Ministry's state management;

+ Regulations on goods and services that are banned from business, restricted from business, and subject to conditional business across borders in accordance with law and as assigned by the Minister;

+ Regulations on food safety management for commercial business establishments and cross-border goods according to the provisions of law and the Minister's assignment;

+ Programs and policies to support the development of production, business, and people's lives in border areas, mountainous areas, islands, and ethnic minority areas.

- Assist the Minister in organizing, directing, guiding, monitoring, examining, summarizing, and evaluating the implementation of mechanisms, policies, strategies, programs, plannings, legislative documents, and regulations on the management of border trade, mountainous areas, islands, and ethnic minority areas after they have been approved and promulgated by competent authorities.

- Help the Minister implement forms and measures to strengthen border economic - trade relations and border economic zones, support and promote the production and consumption of products and goods, and ensure the quality and safety of food in border areas, mountainous areas, islands, and ethnic minority areas.

+ Preside over or coordinate with relevant agencies and units to organize bilateral or multilateral conferences, seminars, and forums on border trade between Vietnam and bordering countries as assigned by the Minister;

+ Coordinate with relevant agencies and units in bordering provinces to monitor, direct, and guide cooperation mechanisms and the management of trade activities in border areas between Vietnam and bordering countries;

+ Assume the prime responsibility for or coordinate with relevant agencies and units in providing information and assisting traders in the implementation of mechanisms and policies on border trade between Vietnam and bordering countries.

- Perform the duties of the Standing Committee of the Border Trade Steering Committee. Advise the Minister in the administration of the Border Trade Steering Committee.

- Help the Minister consider and appraise the grant and extension of permits and certificates of sale and purchase of goods through auxiliary border gates or border openings located outside border-gate economic zones as prescribed by law.

- Assume the prime responsibility for or coordinate with units in the Ministry and the Departments of Industry and Trade in guiding, directing, managing, examining, synthesizing, and reporting on the operation situation and the implementation of the law, the state management of border trade, mountainous areas, and ethnic minority areas according to the provisions of the law and as assigned by the Minister.

- Assist the Minister in guiding and managing the activities of professional associations operating in the field of trade and border goods exchange in accordance with the law.

- Join with units in the Ministry in the implementation of plans, projects, and programs on trade promotion in border, mountainous, island, and ethnic minority areas.

- Coordinate with relevant units to monitor and summarize the situation of entry and exit (people and means of transport), goods, and items crossing the border; forecast arising situations and propose solutions.

- Make reports (periodically and irregularly), assessing the situation of commercial activities, traders and markets in border areas, mountainous areas, islands and ethnic minority areas.

- Perform other tasks assigned by the Minister.
