1. Subjects and scope of support for the usage fee of public irrigation products and services in Vietnam

According to Article 11 of Decree 96/2018/ND-CP, the subjects and scope eligible for support for the usage fee of public irrigation products and services are as follows:

- Households and individuals using agricultural land for producing food crops include:

+ The entire area allotted for producing food crops, including inherited, donated, or transferred land-use rights;

+ The entire area of agricultural land used for research, experimental production; annual cropland with at least one rice crop annually. This includes land planned for at least one rice crop per year or land planned for annual crops but actually cultivating at least one rice crop annually.

- Households and individuals classified as poor by regulations who are assigned agricultural land by the State.

- Households and individuals using land for salt production.

- Households and individuals using agricultural land within the limit for cultivating vegetables, colors, seedlings; long-term industrial crops, short-term industrial crops including winter crops; fruit trees; flowers; medicinal plants; aquaculture (excluding farming in lakes, reservoirs, rivers, streams, lagoons...); animal husbandry.

- Households and individuals as farm staff who received land within the allocated stable contract limits from agricultural companies, forestry companies (state-owned farms and forestry) for agricultural production as per legal regulations.

- Organizations and individuals tasked with draining water in rural and urban areas, except for urban core areas.

- Organizations and individuals responsible for flood management, tide blocking, salinity prevention, salinity flushing, alkaline washing, and maintaining freshwater in the area.

2. Support rates for the use of public irrigation products and services in Vietnam under Decree 96/2018

The support level for the usage fee of public irrigation products and services as stipulated in Article 12 of Decree 96/2018/ND-CP is as follows:

- Support 100% of the usage fee for public irrigation products and services for subjects specified in clauses 1, 2, 3, 4, and 5 of Article 11 Decree 96/2018/ND-CP:

+ Based on specific prices decided by the Ministry of Agriculture and Rural Development and provincial People's Committees on the basis of maximum prices stipulated by the Ministry of Finance according to authority;

+ Calculated from the point of product and service delivery between the supplying organization or individual and the using organization or individual to the main irrigation works' starting point. The Ministry of Agriculture and Rural Development provides detailed regulations on the point of delivery for irrigation products and services as specified in Article 33 of the Water Resources Law 2017;

+ Costs from the point of delivery for irrigation products and services to the cultivated land responsibility lie with the organizations or individuals using irrigation products and services.

- Support 100% of product and service fees for subjects specified in clause 6 of Article 11 Decree 96/2018/ND-CP at specific prices decided by the Ministry of Agriculture and Rural Development and provincial People's Committees, based on maximum prices stipulated by the Ministry of Finance according to authority.

- Financial support for subjects specified in clause 7 of Article 11 Decree 96/2018/ND-CP based on actual volumes of work and tasks approved by provincial People's Committees and the local budget's payment capability to determine support levels.

- The support level is implemented according to the principle of one area; one irrigation, drainage measure; one cubic meter; one work content according to specific prices of public irrigation products and services and in normal weather conditions.

- Subjects not eligible for support for the usage fee of public irrigation products and services must pay the usage fee of public irrigation products and services as regulated.
