Support policies for individuals requiring emergency potection in Vietnam from July 01, 2021

From July 01, 2021, support policies for individuals requiring urgent protection have undergone significant changes according to Circular 02/2021/TT-BLDTBXH guiding Decree 20/2021/ND-CP on social assistance policies for social protection beneficiaries in Vietnam.

To be specific, Article 3 of Circular 02 specifies policies for individuals requiring emergency potection as stipulated in Clause 2, Article 18, and Clause 2, Article 19 of Decree 20/2021/ND-CP as follows:

- Meal allowance during the period of living with the caregiving household: VND 60,000/person/day. (Currently, Article 3 of Joint Circular 29/2014/TTLT-BLDTBXH-BTC stipulates a meal allowance of VND 40,000/person/day).

- Medical treatment costs for cases requiring treatment at healthcare facilities are implemented as follows:

+ For individuals with health insurance cards: follow the legal provisions on health insurance.

+ For individuals without health insurance cards: support for medical examination and treatment costs equivalent to the health insurance fund coverage for those with health insurance cards.

Currently, the regulation for treatment costs for cases requiring treatment at healthcare facilities without health insurance cards is implemented as follows:


+ Children under 6 years old; individuals from poor households, near-poor households; ethnic minorities living in economically and socially difficult or extremely difficult areas; individuals entitled to policies according to the law on preferential treatment for people with meritorious service to the revolution are supported with medical examination and treatment costs equivalent to the health insurance fund coverage for corresponding individuals;


+ For individuals not covered under Point a of this Clause who do not have any relatives, support for medical examination and treatment costs is equivalent to the health insurance fund coverage for individuals from poor households.

- Costs of transporting individuals back to their residence or to social support facilities: Costs follow the common public transport rates applicable at the local level:

+ For cases where transportation is arranged by the agency or unit, the support rate is 0.2 liters of gasoline/1 km calculated based on the actual number of kilometers and the gasoline price at the time of transportation. (Currently, the regulation specifies calculation based on the actual number of kilometers and fuel consumption).

+ For cases where vehicles are hired, the rental price according to the contract agreement, consistent with local prices at the time of hire.

individuals requiring emergency potection subject to temporary community care and nurturing according to Clause 2 of Article 18 of Decree 20/2021/ND-CP include:


- Children whose both parents have died or are missing according to the law, who do not have relatives to care for and nurture them, or whose relatives are unable to care for and nurture them;


- Victims of domestic violence; victims of sexual, physical abuse; victims of trafficking; victims of forced labor needing urgent protection while awaiting return to their residence or entry into social support facilities, social houses;


- Children, homeless individuals begging while awaiting return to their residence or entry into social support facilities, social houses;


- Other individuals requiring emergency potection as decided by the President of the provincial People's Committee.
