Supplementing Regulations on Probationary Period for Employees

Draft of the amended Labor Code is expected to take effect from January 01, 2021. Notably, in this Draft, there is an additional provision regarding the probation period for employees.

To be specific, according to the Draft, the probation period agreed upon by both parties based on the nature and complexity of the work but can be conducted only once for a job and must ensure the following conditions:

- Not exceeding 180 days for the job of an enterprise manager according to the Enterprise Law.

- Not exceeding 60 days for jobs with occupational titles requiring professional and technical qualifications from college level and above.

- Not exceeding 30 days for jobs with occupational titles requiring intermediate professional and technical qualifications, technical workers, and employees in service roles.

- Not exceeding 6 working days for other types of jobs.

Thus, alongside continuing to inherit the regulations on probation periods for employees in the 2012 Labor Code, the Draft has added a probation period for enterprise managers, which will not exceed 180 days.
