Regarding this issue, LawNet would like to answer as follows:
Circular 02/2023/TT-UBDT dated August 21, 2023, amending Circular 02/2022/TT-UBDT guiding the implementation of projects under the National Target Program for socio-economic development in ethnic minority and mountainous areas for the period 2021-2030, Phase I: from 2021 to 2025, issued by the Minister and Chairman of the Committee for Ethnic Minorities.
The subjects receiving support for production land in ethnic minority and mountainous areas include:
- Poor ethnic minority households living in ethnic minority and mountainous areas;
- Poor Kinh households living in extremely difficult communes and extremely difficult villages in ethnic minority and mountainous areas, living on agriculture, forestry, and fishing without any productive land, if there is a need to support production land, the local government will consider direct support with production land;
- Poor ethnic minority households living in ethnic minority and mountainous areas;
- Poor Kinh households living in extremely difficult communes and extremely difficult villages in ethnic minority and mountainous areas, living on agriculture, forestry, and fishing, do not have or lack more than 50% of productive land according to the prescribed norms of each locality. If there is a need to change occupations or if there is a need for support for production land but they cannot arrange production land, they will be considered and supported to change occupations.
Provincial People's Committees rely on the land fund and actual local conditions to set production land quotas but do not exceed the agricultural land allocation limit for each household or individual according to the provisions of land law as a basis for determining households lacking productive land.

The contents of direct support with production land in ethnic minority areas are prescribed as follows:
- In case the locality still has land capable of production without having to carry out reclamation, restoration, or land improvement, the district People's Committee, based on the land use planning and plans approved by competent state agencies, will allocate productive land to policy beneficiaries who do not have productive land according to the provisions of land law. band.
- In cases where a locality still has a productive land fund but must reclaim, rehabilitate, or improve the land to be capable of production, the district People's Committee shall direct the organization of the establishment and implementation of land reclamation, restoration, and improvement projects according to the planning and land use plan approved by the competent state agency to allocate production land to policy beneficiaries who do not have production land according to the provisions of land law.
The level of support from the central budget to implement land reclamation, restoration, and improvement projects is specified in Clause 3, Article 3 of Decision 04/2023/QD-TTg.
- Households subject to direct support for production land in Clause 1, Article 8 of Circular 02/2023/TT-UBDT but for whom the local government cannot arrange production land and needs to borrow capital to create a production land fund shall be considered for credit loans from the Bank for Social Policies according to the provisions of Articles 20, 21, 22, 23, 24, and 25 of Decree 28/2022/ND-CP and will not be supported in career change.
- The Provincial People's Committee directs the District People's Committee to allocate local budgets and issue land use rights certificates to households supported by production land according to regulations.
