Regarding this issue, LawNet would like to answer as follows:
1. Subjects eligible to be recruited as commune-level civil servants in Vietnam
According to Clause 1, Article 14 of Decree 33/2023/ND-CP, the subjects who are accepted as commune-level civil servants include:
- Public employees working at public non-business units;
- People who receive salaries in the people's armed forces, people who work in cipher organizations but are not civil servants;
- Persons who quit their positions as cadres at commune level (except in the form of disciplinary dismissal);
- Persons who used to be cadres and civil servants (including commune-level cadres and civil servants) and then were transferred or rotated by the competent authority to hold positions other than cadres and civil servants at other agencies and organizations.
Pursuant to Article 13 of Decree 33/2023/ND-CP stipulating the recruitment of commune-level civil servants, the provisions of the Government's Decree on the recruitment, employment, and management of civil servants shall apply, including:
- Bases for recruitment of commune-level civil servants.
- Conditions for registration for recruitment of commune-level civil servants.
Particularly the title of civil servant, Commander of the Commune-level Military Command, in addition to the conditions for registration for recruitment of commune-level civil servants as prescribed in Clause 2, Article 13 of Decree 33/2023/ND-CP must also fully satisfy the criteria specified in Article 7 and Clause 1, Article 10 of Decree 33/2023/ND-CP.
- Subjects and priority points in the entrance exam or selection of commune-level civil servants.
Particularly, young intellectuals who volunteer to participate in rural and mountainous development and part-time workers at commune level for 24 months or more who have been assessed and classified as completing tasks or more will add 2.5 points to the second round score.
- Commune-level civil servant recruitment council.
- Form, content, and time of examination for recruitment of commune-level civil servants.
Particularly, for those who have obtained the results of input quality assessment according to the Government's regulations on the quality of entrance examination of civil servants who participate in the commune-level civil servant recruitment exam, they do not have to take the first round exam according to the Government's regulations on recruitment, employment, and management of civil servants.
- Determining the successful candidates in the commune-level civil service recruitment exam.
- Subjects for selection of commune-level civil servants.
Particularly for the title of civil servant, Commander of the Commune-level Military Command, the selection of qualified candidates will be carried out according to the provisions of Article 7 and Clause 1, Article 10 of Decree 33/2023/ND-CP; the appointment of titles will be made in accordance with the law on militia and self-defense forces.
- Content and form of examination of commune-level civil servants.
- Determining the successful candidates in the examination for commune-level civil servants.
- Announcement of recruitment and receipt of registration forms for recruitment of commune-level civil servants.
- Order of organizing recruitment of commune-level civil servants.
- Announcement of the results of the recruitment of commune-level civil servants.
- Completing recruitment dossiers for commune-level civil servants.
- Deciding on recruitment and acceptance of jobs for commune-level civil servants.
- Apprenticeship for commune-level civil servants.
+ Particularly, the probationary period for commune-level civil servants is implemented as follows: 12 months for recruited civil servants with university training or higher; 06 months for recruited civil servants with less than university training. Do not implement the probationary regime for the titles of civil servant and head of the commune-level Military Command.
+ For persons recruited to hold the title of commune-level civil servant, complete the probationary regime as prescribed in Clause 15, Article 13 of Decree 33/2023/ND-CP, and the Chairman of the People's Committee of the commune shall request the President of the People's Committee of the district to decide on the recognition of the end of the probationary period and salary arrangement for the recruited civil servants.
According to Clause 2, Article 5 of Decree 33/2023/ND-CP, commune-level civil servants defined in Clause 1, Article 2 of Decree 33/2023/ND-CP have the following titles:
- Commander of the Military Command;
- Office - statistics;
- Cadastral - construction - urban and environment (for wards and townships) or cadastral - agriculture - construction and environment (for communes);
- Accouting financial;
- Justice - civil status;
- Sociocultural.
