1. Standards for village heads and neighborhood heads in Vietnam

According to Article 11 of Circular 04/2012/TT-BNV, village head, neighborhood head, and village deputy head, neighborhood deputy head must be a person who has permanent or regular residence in the village or neighborhood:

- Is 21 years of age or older, healthy, enthusiastic and sense of responsibility in his/her work;

- Has good political credentials and moral qualities, and is trusted by the people;

- In addition, he/she and his/her family are good samples that comply with guidelines and policy of the Communist Party, policies, laws of State and local regulations;

- Gain cultural knowledge, competence, experience and methods of mobilizing and direct the people to implement self-management work of the community and perform tasks assigned by superior authorities.

2. Duties and entitlement of village heads and neighborhood heads in Vietnam

Duties and entitlement of village heads and neighborhood heads according to Article 10 of Circular 04/2012/TT-BNV (amended in Circular 14/2018/TT-BNV) are as follows:

2.1. Duties

- Convening and chairing meetings of villages and neighborhood groups; organizing the implementation of the work within the village, population groups have been discussed and decided by the people; ensuring the activities of villages and residential groups as prescribed in Article 5 of Circular 04/2012/TT-BNV (amended in Circular 14/2018/TT-BNV):

+ Communities in villages and residential quarters discuss and decide on the policy and level of contribution to the construction of infrastructure and public welfare works within the commune, hamlet, and residential group level fully or partially contributed by the people and self-managed within the population community in accordance with the provisions of the law.

+ The community participates in the discussion and votes for the competent authorities to decide; consult before the competent authority decides on the work of the village, population group, and commune level in accordance with the Ordinance on Implementation of Democracy in Communes, Wards, and Townships.

+ Formulating and implementing village conventions; participating in self-management in maintaining security, order, social safety, and environmental sanitation; preserving and promoting good cultural traditions in the locality, preventing and combating social evils.

+ Implementing the guidelines and guidelines of the Party, policies, and laws of the State; participating in and responding to movements and campaigns launched by the Party, State, Fatherland Front, and socio-political organizations.

+ Electing, relieving from duty, and removing from office the village head and the head of the population group.

- Mobilizing and organizing the people to well implement democracy at the grassroots level and through village conventions and conventions already approved by competent agencies;

- Gathering, reflect, and request the commune-level authorities to settle the legitimate recommendations and aspirations of the people in the villages and residential quarters. To promptly report to the commune-level People's Committees on violations of the law in villages and residential quarters;

- Making a record of the results discussed by the people of the village and the street population group and deciding directly the work of the village or residential group; make minutes on the results discussed and voted on by the people of the village and the street population groups on the work within the scope of the commune; report the results to the Chairman of the commune-level People's Committee;

- Coordinating with the Front's Working Committee and socio-political organizations in villages and neighborhood groups to mobilize people to participate in the implementation of movements and campaigns launched by these organizations;

- In the first six months of the year and at the end of the year, the results of the work must be reported to the village meeting, the population group.

2.2. Entitlement

- Being able to sign contracts on the construction of works funded by the people in the villages and residential quarters, which have been approved by the village meetings and residential groups, and ensure relevant regulations of the authorities at all levels;

- Being assigned the task of solving work to the Deputy Head of the village, the Deputy Head of the residential group; being invited by the commune-level government to meet and provide information and documents related to the management and operation of villages and residential quarters; receiving training in the organization and operation of villages and residential quarters.
