Regarding this issue, LawNet would like to answer as follows:

1. Standards for officers inspecting fire safety and rescue in Vietnam

According to Clause 1, Article 4 of Circular 141/2020/TT-BCA stipulating the standards for officers to inspect fire prevention and fighting and rescue suffering and rescue:

- Inspectors of the Fire Prevention and Fighting Police Department must meet the following standards:

+ Having a university or higher degree in fire safety and rescue; University degree or higher in the field of security and social order or university degree or higher in the field of engineering and have undergone training in law and professional skills of the People's Public Security;

+ Having performed fire safety and rescue work in the People's Public Security Force for at least 5 years;

+ Having satisfactory results of inspections of fire safety and rescue operations

- Inspectors of the Police Department of Fire Prevention and Fighting and Rescue and Rescue Police of provinces and centrally run cities (hereinafter abbreviated as the Police Department of Fire Prevention and Fighting and Rescue and Rescue of the Provincial Police), in addition to meeting the standards specified at Point a, Clause 1, Article 4 of Circular 141/2020/TT-BCA, must also meet the following criteria:

+ Having performed fire safety and rescue work in the People's Public Security Force for at least 3 years;

+ Having satisfactory results of inspections of fire safety and rescue operations.

- Inspectors of police offices of districts, towns, and provincial cities (hereinafter abbreviated as district-level police) must meet the following criteria:

+ Having an intermediate or higher degree in fire safety and rescue; intermediate or higher in the group of security and social order; or intermediate or higher in the group of technical disciplines and having undergone training in law and professional skills of the People's Public Security;

+ Having worked in the People's Police Force for at least 01 year;

+ Having satisfactory results of inspections of fire safety and rescue operations

- Police of communes, wards, and townships (collectively referred to as commune-level police) shall arrange officers to perform inspection tasks on fire safety and rescue, who must meet standards specified at Point a, Clause 3, Article 4 of Circular 141/2020/TT-BCA and must be trained in fire safety and rescue.

2. Duties of officers inspecting fire safety and rescue in Vietnam

Pursuant to Article 5 of Circular 141/2020/TT-BCA, the tasks of fire safety, inspection, and suffering and rescue officers are as follows:

The inspection officer has the following duties:

+ Advising and directing leaders to organize the work of grasping the situation and conducting basic investigations to serve the management of fire safety and rescue in the areas and establishments assigned to manage;

+ Performing basic professional work and working on professional records and statistics in service of fire safety and rescue;

+ Propagating and disseminating laws and knowledge on fire safety and rescue; building a movement of all people to participate in fire safety and rescue;

+ Participating in the inspection and acceptance of fire prevention and fighting;

+ Carrying out safety inspections of fire safety and rescue according to the prescribed order and procedures; monitor and urge the overcoming of unsafety risks and violations of regulations on fire safety and rescue;

+ Inspecting conditions for fire prevention and fighting service providers according to the prescribed order and procedures;

+ Advising on the issuance of permits to transport dangerous goods of fire and explosion according to the provisions of law;

+ Professional training in fire safety and rescue; guiding the formulation and practice of fire fighting plans and rescue plans for the facility;

+ Understanding the situation, coordinating to support firefighting and rescue when a fire occurs in the area or facility assigned to manage it, and participating in the investigation and settlement of fires and explosions in accordance with the law;

+ Performing information regime, reporting, and other tasks assigned by superiors;

+ Handling administrative violations on fire prevention and fighting; suspending or advising to suspend the operation of establishments, motor vehicles, households, and individuals that fail to ensure safety in fire prevention and fighting as prescribed.

- Inspectors of the Fire Prevention and Fighting and Rescue Police Department perform the tasks specified at Points a, b, c, d, dd, e, h, i, k and point 1, clause 1 of Article 5 Circular 141/2020/TT-BCA.

- Inspectors of the Police Department of Fire Prevention and Fighting and Rescue and Rescue of the Provincial Police shall perform the tasks specified in Clause 1 of Article 5 of Circular 141/2020/TT-BCA.

- Inspectors of the district-level police department perform the tasks specified at points a, b, c, d, dd, g, h, i, k and point 1, clause 1, article 5 of Circular 141/2020/TT-BCA.
