Regarding this issue, LawNet would like to answer as follows:

1. General standards of officers of the Military Judgment Branch

According to Clause 1, Article 3 of Circular 19/2018/TT-BQP, the titles of officers of the Military Judgment Execution Sector include: Heads and Deputy Heads of judgment enforcement agencies; bailiffs; examiners; Judgment Secretary.

Specifically, the general standards of officers in the Military Judgment Sector include:

- Being absolutely loyal to the interests of the Party, the nation - the nation and the people; adhering steadfastly to Marxism-Leninism, Ho Chi Minh's thought, and the ideal goal of national independence and socialism.

- Exemplary of moral qualities; need, thrift, integrity, righteousness, justice and impartiality; no corruption, opportunism, or self-interest; politeness, cultural awareness, communication, and serving the people.

- Regularly having a sense of learning and training to improve quality, qualifications and professional capacity.

- Having the age prescribed by the Law on Officers of the Vietnam People's Army, the Law on Professional Soldiers, National Defense Workers and Officials; meeting the training criteria as prescribed by law; and being healthy enough to complete assigned tasks.

2. Standards for Examiner ranks in the Army in Vietnam

2.1. Standards for the Examiners

Specifically, in Clause 1, Article 12 of Circular 19/2018/TT-BQP (amended in Circular 10/2023/TT-BQP) stipulates the standards of examiners are stipulated as follows:

- Professional officers and soldiers in active service who fully meet the criteria specified in Section 1;

- Possess a bachelor's degree in law or higher;

- Having worked in law for at least 3 years (36 months) or more;

- Having a certificate of training in state management knowledge and civil judgment enforcement operations according to the contents and programs of the Ministry of Justice.

2.2. Standards for the Principal Examiners in Vietnam

The main examiner rank must meet the criteria specified in Clause 2, Article 12 of Circular 19/2018/TT-BQP (amended in Circular 10/2023/TT-BQP) as follows:

- Active duty officers who fully meet the criteria specified in Section 1;

- Having held the rank of examiner or equivalent for a full 9 years or more, of which the period of holding the rank of examiner must be at least 1 year (full 12 months) up to the date of the request for appointment;

- Having a certificate of training in state management knowledge and major civil judgment enforcement operations according to the contents and programs of the Ministry of Justice.

2.3. Standards for Senior Examiners in Vietnam

To earn the title of Senior Examiner, an individual must meet the following criteria:

- Active duty officers who fully meet the criteria specified in Section 1;

- Having held the rank of principal examiner or equivalent for full 06 years or more (full 72 months); in which the period of holding the rank of principal examiner is at least 1 year (full 12 months) up to the date of request for appointment;

- Having an advanced diploma in political theory or an advanced political-administrative theory or a bachelor's degree in politics or have a certificate of equivalent advanced level of political theory as prescribed;

- Having a certificate of training in state management knowledge and advanced civil judgment enforcement according to the contents and programs of the Ministry of Justice.

3. Application for appointment of Examiners in the Army in Vietnam

According to Clause 2, Article 13 of Circular 19/2018/TT-BQP, the application for the appointment of a verifier in the Army includes the following components:

- A report of the Council for consideration and a request for the appointment of examiners in the Army;

- Appraisal documents of the General Department of Politics for officers or the Military Department of the General Staff for professional soldiers;

- A written request from the Standing Party Committee of the Party Committee at the military zone level, the Party Committee of the Judgment Execution Department of the Ministry of National Defense;

- Self-criticism of the person proposed for appointment;

- Curriculum Vitae (T63);

- Declaration of assets and income;

- Copies of diplomas, certificates, and other relevant documents.

The application file of the Standing Committee of the Party Committee of the military zone shall be sent to the Central Military Commission through the Judgment Execution Department of the Ministry of National Defense.

4. Order of Appointment of Examiners in the Army

Clause 1, Article 13 of Circular 19/2018/TT-BQP stipulates the order of appointment of examiners in the Army as follows:

- Every year, the Judgment Execution Department of the Ministry of National Defense coordinates with functional agencies of the General Staff, military zones, and Navy to agree on personnel to appoint examiner ranks in the Army;

- The Standing Committee of the Party Committee at the military zone level, the Party Committee of the Judgment Execution Department of the Ministry of National Defense, shall carry out the process of requesting an appointment according to the Regulation on Cadre Work of the Central Military Commission;

- The Department of Judgment Execution of the Ministry of National Defense summarizes and reviews standards, documents, and procedures, and makes a list to seek appraisal opinions from the General Department of Politics for officers and the Military Department of the General Staff for professional soldiers;

- The Council for the approval and nomination of examiners in the Army shall make a list and report to the Head of the Ministry of National Defense for appointment.
