Regarding this issue, LawNet would like to answer as follows:
Specifically, Article 18 of Decree 72/2023/ND-CP stipulates standards and norms for using automobiles to serve state reception as follows:
- Standards and norms for using automobiles to serve foreign affairs of the Party and State (hereinafter referred to as automobiles serving state reception):
+ Vehicles serving Heads of State, Deputy Heads of State, Chairman of the National Assembly, Prime Minister, Secretary General of the United Nations, and Foreign Ambassadors presenting credentials (hereinafter referred to as Group 1): Maximum of 04 vehicles.
+ Vehicles serving the Vice Chairman of the National Assembly, Deputy Prime Minister, Minister of Foreign Affairs or equivalent, wife or husband of the Head of State, Deputy Head of State, Chairman of the National Assembly, Prime Minister
(hereinafter referred to as Group 2): Maximum 18 vehicles.
+ Vehicles serving other Ministers, members of high-ranking Youth Unions, members of Youth Unions at the level of Deputy Heads of State, members of the Royal Family (Princes, Crown Princes, Princesses, etc.), Presidents of the ruling Party,... State guest delegations of ministries, central agencies, and serving Vietnamese officials participating in welcoming the delegation (hereinafter referred to as Group 3): Maximum of 37 vehicles.
+ Luggage vehicles for international delegations making official visits to our country and high-level delegations of our Party and State visiting other countries (hereinafter referred to as Group 4): Maximum of 03 vehicles.
- Automobiles serving state receptions are equipped and assigned to the Ministry of Foreign Affairs to manage and use to serve the Party and State's foreign affairs work.
The Ministry of Foreign Affairs presides over and coordinates with the Ministry of Finance and relevant agencies to submit to the Prime Minister a specific decision on the type and purchase price of each automobile group prescribed in Clause 1, Article 18 of Decree 72/2023/ND-CP when purchasing equipment that meets the requirements for foreign affairs of the Party and State, in accordance with the actual situation and conditions of the country in each period.
Pursuant to Article 19 of Decree 72/2023/ND-CP, the regulations on replacing automobiles to serve state reception are as follows:
- Conditions for replacing automobiles to serve state reception:
+ Automobiles serving state reception are replaced when they have been in use for more than 10 years or have been operated for more than 150,000 km.
+ Automobiles that do not fall under the provisions of Point a, Clause 1, Article 19 of Decree 72/2023/ND-CP but are damaged beyond repair or the repair is ineffective (estimated repair cost is 30% greater than the original price).
- Automobiles that do not meet the conditions prescribed in Clause 1, Article 19 of Decree 72/2023/ND-CP and need to be replaced to ensure the requirements for foreign affairs of the Party and State, the Minister of Foreign Affairs reports to the Prime Minister for consideration and decision.
- When automobiles serving state reception (old) are replaced, the Ministry of Foreign Affairs agrees with the Ministry of Finance to handle the following:
+ Transfer between groups (transfer from Group 1 to Group 2 or Group 3, transfer from Group 2 to Group 3); Minister of Foreign Affairs; decided to move automobiles between groups to continue using them to serve state receptions.
+ Be handled in other forms according to the provisions of the Law on Management and Use of Publics Property and documents detailing implementation.
More details can be found in Decree 72/2023/ND-CP takes effect on November 10, 2023, replacing Decree 04/2019/ND-CP.
