Regarding this issue, LawNet would like to answer as follows:

1. Special nutrition diet for high-performance athletes and sports coaches in Vietnam

The special nutrition diet for high-performance athletes and sports coaches according to Article 4 of Decree 36/2019/ND-CP is as follows:

- High-performance athletes are entitled to a Special nutrition diet to ensure adequate nutrition necessary for their ability to practice and compete in high-performance sports, including:

+ Daily meals;

+ Functional foods.

- High performance sports coaches are entitled to a daily meal plan.

- The time to enjoy a special nutrition diet is calculated during the training and competition time of the coach and athlete.

- Coaches and high-performance sports athletes who are summoned to national sports teams to prepare to participate in the Southeast Asian Games (hereinafter referred to as SEA Games), ASIAD and Olympic Games shall enjoy a higher nutritional regime of no more than 50% of the level specified in Clause 1, Article 4 of Decree 36/2019/ND-CP for a period of no more than 90 days.

- Coaches and high-performance athletes are called up to national sports teams and have the ability to win gold medals at ASIAD and win gold medals at the Youth Olympic Games (hereinafter referred to as Youth Olympic Games), capable of meeting the standards to participate in the Olympic Games, and coaches and athletes participating in the Paralympic Games are entitled to a higher nutritional regime not exceeding 100% of the level prescribed in Clause 1 of Article 4 Decree 36/2019/ND-CP.

- High-achieving athletes are called up to national sports teams and have the ability to win medals at ASIAD, participate in qualifying rounds, and attend the Olympic Games and athletes participating in the Paralympic Games are entitled to a functional food regime according to the specific nature of each sport, according to the regulations of the Minister of Culture, Sports, and Tourism.

- Coaches and athletes when training abroad are entitled to daily meals according to the invitation or contract signed between the domestic athlete management agency and the training facility abroad.

- When market price fluctuations are equal to (=) or greater than (>) 10%, as announced by the General Statistics Office, the Ministry of Finance presides over and coordinates with the Ministry of Culture, Sports, and Tourism to agree on adjusting spending levels to implement appropriate nutrition regimes.

2. Health care and injury treatment regimes for high-performance athletes and sports coaches in Vietnam

Health care and injury treatment regimes for high-performance athletes and sports coaches according to Article 3 of Decree 36/2019/ND-CP are as follows:

- Units employing high-performance athletes are responsible for:

+ Initial health check for athletes as soon as they are recruited into training facilities and sports teams;

+ Periodic health checks for athletes at least 2 times/year;

+ Health check for athletes before participating in high-performance sports tournaments.

- The content of the athlete's health check specified in Points a and b, Clause 1, Article 3 of Decree 36/2019/ND-CP includes:

+ Check and evaluate physical fitness level;

+ Check and evaluate morphology;

+ Psychological testing and assessment;

+ Inspection and evaluation of biomedicine.

- The content of the health check for athletes specified in Point c, Clause 1, Article 3 of Decree 36/2019/ND-CP is implemented in accordance with the provisions of the law.

- High-performance athletes receive health care, rehabilitation, and injury treatment at domestic medical facilities.

In special cases, the Minister of Culture, Sports, and Tourism decides to allow high-achieving athletes to be summoned to train with national sports teams to prepare to participate and have the ability to win medals at the Asian Games (hereinafter referred to as ASIAD), attend the Olympic Games (hereinafter referred to as the Olympic Games) and athletes participating in the World Paralympic Games (hereinafter referred to as the Paralympic Games) are treated for injuries abroad.
