Regarding this issue, LawNet would like to answer as follows:

1. Salary regime for police workers in Vietnam

The salary regime for police workers according to Article 9 of Decree 49/2019/ND-CP is as follows:

- Salary schedule for police workers is specified in the Appendix issued with Decree 49/2019/ND-CP.

The Minister of Public Security stipulates job titles for each group and salary range.

- Increase salary and rank for police workers:

+ Police workers who complete assigned work, meet the prescribed technical rank standards and have not yet reached the last salary level in the rank will be considered for a regular salary increase after 2 years (full 24 months) of maintaining the salary level for people with a salary coefficient of 3.95 or less, and after 3 years (full 36 months), keep the salary level for people with a salary coefficient of over 3.95.

During the time limit for considering a salary increase, if the task is not completed or is disciplined in the form of reprimand, the salary increase period will be extended by 6 months; If disciplined in the form of a warning or higher, the salary increase period will be extended for 12 months.

In case of achieving particularly excellent achievements in performing tasks, the salary level will be increased up to 12 months or beyond;

+ Police workers who fulfill well or excellently assigned responsibilities and tasks, have the ability to assume higher job positions in the same industry or technical profession, and have appropriate qualifications will be considered for promotion.

- Transfer salaries to the Police Worker Salary Table:

+ When transferring salary, it is not allowed to combine salary grade or salary increase;

+ The transfer of salary from the current salary coefficient to the salary coefficient specified in the Police Worker Salary Table issued in the Appendix attached to Decree 49/2019/ND-CP is based on the working time for which social insurance is paid (if there is an intermittent period of social insurance payment without receiving a one-time social insurance benefit, it will be accumulated) in accordance with the job position and regulations in Clause 2, Article 9 of Decree 49/2019/ND-CP.

In case there is a new salary coefficient plus extra seniority allowances that is lower than the current salary coefficient plus extra seniority allowances and allowances for national defense and security will be entitled to a reserved difference coefficient equal to the total salary coefficient, extra seniority allowances and allowances for national defense and security services currently enjoyed. The reservation difference coefficient gradually decreases as the salary level increases.

- Police workers are entitled to allowances and benefits including:

+ Extra seniority allowance;

+ Regional allowance;

+ Special allowances;

+ Toxic and dangerous allowances;

+ Work responsibility allowance;

Conditions, time, and benefit levels of allowances at Points a, b, c, d and dd Clause 4 Article 9 Decree 49/2019/ND-CP are implemented as prescribed in Decree 204/2004/ND-CP on the salary regime for officials, civil servants, public employees, and armed forces.

+ Civil service allowances:

++ Applicable to police workers receiving salaries from the state budget;

++Conditions, time, and level of civil service allowances are implemented as prescribed in Decree 34/2012/ND-CP on civil service allowances.

+ Allowances and allowances for working in areas with extremely difficult socio-economic conditions:

Conditions, time, and benefit levels are implemented as prescribed in Decree 76/2019/ND-CP on policies for officials, civil servants, public employees, and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions.

- Funding sources for implementation:

+ For estimate units guaranteed by the state budget according to the provisions of law on state budget;

+ For businesses, deductible expenses are included when determining the taxable income of the business.

- Police workers who apply the salary schedule specified in Decree 49/2019/ND-CP are not entitled to allowances for national defense and security services specified in Point dd, Clause 8, Article 6 of Decree 204/2004/ND-CP.

2. Seniority allowance for police workers in Vietnam

The seniority allowance regime for police workers in Vietnam according to Article 10 of Decree 49/2019/ND-CP is as follows:

- Allowance level:

Police workers who have served in the People's Police for a full 5 years (60 months) are entitled to a seniority allowance equal to 5% of their current salary plus a leadership position allowance and extra seniority allowance (if any); From the sixth year onwards, each year (12 months) is charged an additional 1%.

Long service allowances are calculated and paid at the same monthly salary period and are used to calculate social insurance, health insurance, unemployment insurance, and insurance for labor accidents and occupational diseases.

- Time to calculate the allowance:

+ Time served in the People's Public Security;

+ The period of enjoyment of seniority allowances in other industries and professions is accumulated with the time specified in Point a, Clause 1, Article 10 of Decree 49/2019/ND-CP to calculate the enjoyment of seniority allowances.

- Time not counted for allowance:

+ Continuous unpaid personal leave period of 01 month or more;

+ Sickness or maternity leave exceeds the period prescribed by the law on social insurance;

+ Time of suspension from work or temporary detention, then being disciplined and forced to quit work.
