Regarding this issue, LawNet would like to answer as follows:

1. Responsibilities of the Minister of Information and Communications in Vietnam

The Minister of Information and Communications is responsible for:

- Decide on tasks under the Ministry's management according to the provisions of law and take personal responsibility before the National Assembly, the Government, and the Prime Minister for all tasks under their responsibility and authority.

- Comprehensively direct and manage the work of the Ministry in accordance with the provisions of the Constitution, the Law on Government Organization, Decree 123/2016/ND-CP, Decree 138/2016/ND-CP, Decree 17/2017/ND-CP, and other legal documents that stipulate the Minister's authority to resolve. Direct large, important, and strategic tasks in the areas of state management of the Ministry and tasks assigned by the Government and the Prime Minister.

- Assign Deputy Ministers to handle work in a number of fields and direct the work of a number of units under the Ministry; Monitor state management in the field of information and communications in a number of provinces and centrally run cities.

- Authorize heads of units under the Ministry to perform a number of specific tasks according to the provisions of law; proactively coordinate with other ministries and agencies to handle issues related to the Ministry's tasks or issues assigned by the Government and Prime Minister.

- Direct the guidance, inspection, and examination of the activities of ministries, branches, People's Committees at all levels, other organizations, local specialized agencies, and units under the Ministry in implementing the law and assigned and decentralized tasks in the areas of state management of the Ministry.

- Sign documents under the authority of the Minister.

- Chair conferences, seminars, and celebrations of the Party, State and Industry assigned by superiors based on the functions of the Ministry.

- Receive citizens according to the provisions of the Law on Receiving Citizens.

2. Scope and method of handling the work of the Minister of Information and Communications in Vietnam

- Jobs falling within the authority specified in the Constitution, the Law on Government Organization, the Government's Working Regulations, relevant legal documents, and the jobs specified in Section 1.

- Work assigned or authorized by the Government or Prime Minister.

- Decide according to authority or submit to the Government or Prime Minister for consideration and decision according to authority on issues related to the functions and tasks of the Industry.

- Promulgate legal documents and administrative documents according to authority to perform state management functions for the Industry.

- In case of necessity, the Minister can directly handle some tasks assigned to the Deputy Minister but only because the content of the issue is urgent or important or because the Deputy Minister is away on business.

- Directly resolve issues related to two or more Deputy Ministers, but the Deputy Ministers have different opinions.

- In his absence and if necessary, the Minister assigns a Deputy Minister to lead the Ministry's work on behalf of the Minister and handle work directly in charge of the Minister.

- When the Deputy Minister is absent, if necessary, the Minister assigns another Deputy Minister to handle or directly handle the work of the absent Deputy Minister.

- Decide to decentralize local authorities to perform a number of tasks related to the Industry according to their authority.

- Tasks that need to be discussed within the Ministry's Leadership team before the Minister decides:

+ Strategies, planning, and plans for industry and field development.

+ Work program and plan for developing annual and long-term legal documents of the Industry; important projects of the Ministry are submitted to the Politburo, Secretariat, National Assembly, Government, and Prime Minister for decision.

+ Action programs and plans of the Industry to implement important guidelines and policies of the Party and State, and important legal documents issued by superiors.

+ Key programs and projects of the Industry.

+ Allocating annual revenue and expenditure estimates and investment and development plans.

+ Organization of the Ministry's apparatus and personnel according to regulations.

+ Annual report summarizing the implementation of the State plan and reviewing the Ministry's executive direction.

+ Issues of signing and participating in international treaties; plans to implement commitments on international integration.

+ Other issues that the Minister finds necessary to discuss.

- In case there are no conditions to organize a collective discussion, according to the direction of the Minister, the unit in charge of the project will coordinate with the Ministry Office to collect opinions from Deputy Ministers and submit them to the Minister for decision.

After the Deputy Ministers have given their opinions, the Minister is the one who makes the final decision and is responsible for his or her decision.
