The responsibilities of the Appraisal Council in planning flood prevention and control for a river with embankments are regulated by Article 12 of Decree 53/2019/ND-CP as follows:

- The Minister of Agriculture and Rural Development shall decide to establish the Appraisal Council and the Assistance Team for the Appraisal Council.

- The Appraisal Council consists of at least 11 members, including:

+ The Chairman of the Council, who is a leader of the Ministry of Agriculture and Rural Development;

+ The Deputy Chairman of the Council;

+ Council members representing the following ministries: Planning and Investment, Finance, Natural Resources and Environment, Construction, Industry and Trade, Transport, and representatives of provincial People's Committees within the planning scope, representatives of planning agencies, and some organizations under the Ministry of Agriculture and Rural Development, planning experts, in which 2 of the members are reviewers.

- Responsibilities and powers of the Appraisal Council:

+ The Chairman of the Council is responsible for the activities of the Appraisal Council; organizing and chairing the meetings of the Appraisal Council; assigning tasks to the members of the Appraisal Council; reporting the results of the appraisal of the planning.

+ The reviewers are responsible for attending all meetings of the Appraisal Council; studying the planning appraisal application; preparing written opinions to be sent to the Assistance Team for the Appraisal Council before the meeting of the Appraisal Council.

+ The members of the Appraisal Council attend the meetings of the Appraisal Council; study the planning appraisal application; prepare written opinions at the meetings of the Appraisal Council regarding their specialized fields and other tasks assigned by the Chairman of the Council; have the right to reserve their opinions.

- The Assistance Team for the Appraisal Council is responsible for receiving, studying, and processing the application, providing the planning appraisal application to the members of the Appraisal Council for studying and giving opinions; organizing the meetings of the Appraisal Council as requested by the Chairman of the Council; drafting the minutes of the Appraisal Council meetings, the draft appraisal report.

Process of appraising the planning of flood prevention and control for a river with embankments in Vietnam

The process of appraising the planning of flood prevention and control for a river with embankments is regulated in Article 15 of Decree 53/2019/ND-CP as follows:

- The planning agency sends the planning appraisal application to the Appraisal Council through the Assistance Team for the Appraisal Council to send to the members of the Appraisal Council for appraisal.

- Within 20 days from the date of receiving the planning appraisal application, the reviewers must send their written opinions to the Appraisal Council through the Assistance Team for the Appraisal Council to organize a meeting.

Note: When necessary, the Appraisal Council may seek the opinions of experts, professional organizations, and other relevant organizations regarding the planning content through conferences, seminars, specialized discussions, and consolidate the opinions in the appraisal report; the Appraisal Council has the right to request the planning agency to provide additional information and explanations on related matters.

- The appraisal session is conducted when at least two-thirds (2/3) of the number of members of the Appraisal Council are present, including the Chairman or Deputy Chairman and 2 reviewers.

- The decision-making mechanism of the Appraisal Council:

+ The Appraisal Council works collectively, openly discusses, and votes by ballot based on majority;

+ The planning is eligible for approval when at least three-fourths (3/4) of the members of the Appraisal Council attending the meeting vote in favor or with amendments.

- Reporting the results of the planning appraisal:

+ Within 10 days from the date of the Appraisal Council meeting, the Council is responsible for completing the report on the results of the planning appraisal;

+ The report on the results of the planning appraisal must clearly reflect the opinions of the Council members and the conclusion of the Chairman of the Council.

- In case the planning is approved or approved with amendments by the Appraisal Council, within 30 days from the date of receiving the report on the results of the planning appraisal, the planning agency is responsible for completing the application and reporting to the Minister of Agriculture and Rural Development. In case the planning is not approved by the Appraisal Council, within a maximum of 90 days from the date of receiving the report on the results of the planning appraisal, the planning agency is responsible for revising the application and reporting to the Ministry of Agriculture and Rural Development.
