Construction planning and bases for construction planning in Vietnam

Pursuant to Article 13 of the Construction Law 2014 as amended by Clause 2, Article 28 of the Law on amendments to some articles concerning planning of 37 laws 2018, inter-district construction planning, district construction planning and dedicated area construction planning is the detailed planning.

Urban planning is the planning mentioned in the national planning and includes the one specified by the Law on Urban Planning.

Formulation, appraisal, approval, adjustment and implementation of the urban planning shall comply with regulations of the law on planning.

Rural planning is the planning mentioned in the national planning and includes the one specified in Clause 2 Article 29 of the Construction Law 2014.

Bases for formulating construction planning include:

- Socio - economic development, national defense and security strategies and plans; industry distribution and development strategies during the same period;

- National planning, regional planning and provincial planning;

- Planning in the previous planning;

- Technical standards for urban planning and other relevant standards;

- Maps, documents and data on local current socio - economic conditions and natural conditions.

Requirements and compliance principles on construction planning in Vietnam 

(1) Requirements on construction planning include:

- Conform to socio - economic development strategy and industry distribution and development strategy; conform to national planning, regional planning and provincial planning; ensure national defense and security, facilitate sustainable socio - economic development; industry distribution and development strategies during the same period; ensure publicity, transparency and harmony of interests between the State, the public and individuals;

- Organizing and arranging territorial space on the basis of rationally exploiting and using natural resources, land, historical relics, cultural heritages and other resources in compatibility with natural and socio-economic conditions, historical and cultural characteristics and scientific and technological advances in each development period;

- Meeting the demand for use of the technical infrastructure system; ensuring connection and uniformity of regional, national and international technical infrastructure facilities;

- Protecting the environment, preventing and fighting natural disasters and responding to climate change, minimizing the adverse impacts on community, conservation, embellishment and development of the value of historical relics, cultural heritages, beliefs and religions; ensuring synchronism in architectural space, social and technical infrastructure facilities;

- Establishing bases for planning, investment management and construction investment attraction, and managing, exploiting and using regional construction works, particular-function zones and rural areas.

(2) Compliance principles for construction planning include:

-The construction, and management of space, architecture and landscape and execution of programs therefor shall comply with the planning mentioned in the national planning prescribed by the law on planning and approved construction planning, and conform to available resources;

- Construction planning must ensure the uniformity and conformity with planning at higher degrees.

Pursuant to: Article 14 of the Construction Law 2014 and Points a, b, Clause 3, Point b, Clause 18, Article 28 of the Law on amendments to some articles concerning planning of 37 laws 2018.

Order of construction planning and approving construction planning in Vietnam

Pursuant to Article 20 of the Construction Law 2014, construction planning shall be demonstrated through construction plans and must comply with the following order:

- Devising and approving construction planning tasks;

- Conducting field investigations and surveys; collecting maps, documents and data on natural conditions, current socio-economic situation, socio-economic development master plans and relevant sectoral development master plans for the formulation of construction plans;

- Formulating construction plans;

- Appraising and approving construction plans.
