Regarding this issue, LawNet would like to answer as follows:
Regulations on uniforms and means of transport of Traffic Police according to Clause 1 and Clause 2, Article 11 of Circular 65/2020/TT-BCA are as follows:
* Traffic Police uniform:
- Traffic police, when patrolling, controlling, and handling violations, use police uniforms and wear People's Police numbers according to regulations of the Ministry of Public Security. When controlling in the evening, at night, or during the day in foggy or bad weather that limits visibility, you must wear reflective clothing;
- In case of control through means and professional technical equipment, a section of plainclothes traffic police will be arranged to operate and use vehicles and professional technical equipment, monitor traffic order and safety, detect violations of road traffic laws, and other violations of law.
When detecting a violation, immediately notify the patrol and public control departments to conduct control and handle it according to the provisions of the law;
Head of the Road Traffic Control and Patrol Guidance Department under the Traffic Police Department, Head of the Traffic Police Department, the Chief of Police of a district, district, town, provincial city, or centrally run city (hereinafter referred to as the Chief of District Police) or higher shall decide:
Wearing police uniforms or plain clothes when using professional vehicles and technical equipment must be clearly stated in the patrol and control plan.
* Means of transport: automobiles, patrol and control motorcycles, specialized vehicles, bicycles
- Patrol and control cars and motorcycles (white paint), specialized vehicles with the words "Bilingual Traffic Police" (Vietnamese and English), installing lights, police flags, and priority signal sirens according to the provisions of law;
- On both sides of the patrol and control car, there are blue reflective paint lines; in the middle, there are the words “CẢNH SÁT GIAO THÔNG” in white (made of reflective material) with a letter size of 10cm x 10cm and a stroke of 03cm, balanced on both sides of the vehicle;
On both sides of the front door are the words "TRAFFIC POLICE" in blue (made of reflective material); the maximum letter size is two-thirds the size of the word “CẢNH SÁT GIAO THÔNG” and a picture of the Traffic Police badge between the words "TRAFFIC" and "POLICE". Depending on each type of vehicle, the distance between letters and words is arranged to be balanced and appropriate;
- On both sides of the fuel tank, on the sides, or on both sides of the trunk of a patrol and control motorbike, above are the words "C.S.G.T" in blue (made of reflective material), below are the words "TRAFFIC POLICE" in blue (made of reflective material), and the maximum letter size is two-thirds the size of the letter "C.S.G.T".
Depending on each type of vehicle, the letter size and spacing between letters are arranged to be balanced and appropriate;
- Priority signaling horns are used according to the provisions of the law. Priority signaling lights are used continuously in the following cases: Patrolling, mobile control; patrolling and controlling in the evening, at night, or during the day in foggy or bad weather conditions that limit visibility.
Forms of patrol and control by the Traffic Police according to Article 9 of Circular 65/2020/TT-BCA are as follows:
* Patrol and mobile control:
Traffic police move on assigned routes and areas by means of transport or on foot, perform patrols and control according to plans approved by competent authorities, and directly supervise;
Or through the use of means and professional technical equipment to monitor, prevent, detect, promptly stop, and strictly handle road traffic violations and other violations, as prescribed by law.
* Control at the Traffic Police Station or at a point on the road:
- Traffic police organize forces at the Traffic Police Station or at a point on the road according to a plan approved by competent authorities to carry out:
+ Total control of road traffic vehicles;
+ Control and handle violations by implementing peak patrol and control;
+ Control and handle violations by topic;
+ Control through professional technical means and equipment;
+ Coordinate with relevant units and agencies to prevent and fight crime, ensure order, traffic safety, security, and social safety;
+ Perform other tasks as directed by competent authorities according to the provisions of the law;
- At the Traffic Police Station, install and use professional technical equipment to record video in the control area. At a point on the road, choose a location with a wide, airy road surface that does not obscure visibility and complies with the law. When controlling in the evening, there must be lights and adequate lighting at night.
* Patrolling, mobile control combined with control at a point or at a Traffic Police Station:
When patrolling, mobile control is controlled at a point on a traffic road, at a Traffic Police Station or when controlling at a point on a traffic road, at the Traffic Police Station, mobile patrols and control are allowed, but must be clearly stated in the patrol and control plan approved by competent authorities.
