Below is the content of the regulations on the restoration of intangible cultural heritage in Vietnam, applicable from June 1, 2024.

Regulations on the restoration of intangible cultural heritage in Vietnam

According to Article 13 of Decree 39/2024/ND-CP  on current regulations on restoration of intangible cultural heritage in Vietnam:

(1) Restoration tasks include: restoring expressions, customs, practices, objects, practice spaces, and related environments of intangible cultural heritage.

(2) The restoration of intangible cultural heritage must adhere to the principles outlined in Article 4 and Article 5 of Decree 39/2024/ND-CP and:

- The restoration of intangible cultural heritage must be formulated into a scheme, tasks presented to the competent authority as prescribed;

- There must be broad participation and consensus from the heritage holders and the provincial and centrally-run city cultural heritage management agency;

- Documentation of the restoration process;

- Submit a report on the results and documentation products to the provincial and centrally-run city cultural heritage management agency and enter them into the national cultural heritage database.

(3) Based on the implementation results of the heritage restoration project, the Chairman of the People's Committee of the province or centrally-run city is responsible for allocating resources to ensure the heritage is practiced and promoted in life.

Regulations on promoting and protecting the value of intangible cultural heritage in Vietnam

- Management, protection, and promotion of heritage value must be formulated into a scheme, tasks presented to the competent authority as prescribed.

- Scheme types include:

+ Schemes for managing, protecting, and promoting the value of one or multiple intangible cultural heritage listed in UNESCO Lists;

+ Schemes for managing, protecting, and promoting the value of one or multiple intangible cultural heritage listed in the National Inventory;

+ Schemes for protecting intangible cultural heritage at risk of being lost or in need of urgent protection.

- Fundamental contents of the scheme include:

+ The necessity of developing the scheme;

+ Domestic and international legal provisions related to management, protection, and promotion of heritage value;

+ Description of one or multiple heritages within the scheme's scope and subject; individual and community heritage holders; heritage value;

+ Current status of practice, management, protection, and promotion of heritage value;

+ Issues, factors, and risks affecting the practice, management, protection, and promotion of heritage value;

+ Analysis and assessment of the scheme's impact on the current practice of intangible cultural heritage;

+ Main contents, tasks, and implementation activities;

+ Timeline and implementation schedule;

+ Implementation funding; names, and contents of component projects (if any);

+ Responsibilities (of agencies, organizations, individuals) in implementation;

+ Propose management, protection, and promotion measures.

- Schemes are developed every 5 (five) years, with a vision of 10 (ten) years.

- Schemes are adjusted, supplemented during implementation as per the implementation schedule or promptly adjusted, supplemented according to the current status of the heritage to ensure suitability and feasibility.
