Regarding this issue, LawNet would like to answer as follows:

1. Customs Departments are organizations working under which agency in Vietnam?

Customs Departments of provinces, inter-provinces, and cities directly under the Central Government (hereinafter collectively referred to as Customs Departments) are organizations directly under the General Department of Customs, with the function of assisting the Director General of the General Department of Customs in the state management of customs and organization of customs law enforcement and other provisions of relevant laws in the area of operation of the Customs Department in accordance with the provisions of law.

The Customs Department has legal status, its own seal, and may open an account at the State Treasury in accordance with law.

Thus, the Customs Department is an organization directly under the General Department of Customs.

2. Regulations on the organizational structure of the Customs Department in Vietnam

According to Decision 1919/QD-BTC 2016, the organizational structure of the Customs Departments of provinces, inter-provinces, and centrally-run cities in Vietnam (hereinafter referred to as the Customs Department) is as follows:

(1) Advisory units to assist the Director of the Customs Department:

- Hanoi Customs Department, Ho Chi Minh City Customs Department, and Hai Phong City Customs Department have 09 rooms, including:

+ Customs Management Supervision Department;

+ Import-Export Tax Department;

+ Prevention of smuggling and handling of violations;

+ Risk Management Department;

+ Department of Inspection - Inspection;

+ Department of Organization and Personnel;

+ Department of Finance - Administration;

+ Office;

Information Technology Department.

- Customs Departments of provinces and cities: Binh Duong, Ba Ria - Vung Tau, Dong Nai, Da Nang, Quang Ninh, Lang Son have 08 rooms, including:

+ Customs Management Supervision Department;

+ Import-Export Tax Department;

+ Prevention of smuggling and handling of violations;

+ Risk Management Department;

+ Department of Organization and Personnel - Inspection;

+ Department of Finance - Administration;

+ Office;

Information Technology Department.

- Customs Departments of provinces: An Giang, Lao Cai, Nghe An, Quang Tri have 05 rooms, including:

+ Professional Affairs Department;

+ Prevention of smuggling and handling of violations;

+ Department of Organization and Personnel - Inspection;

+ Department of Finance - Administration;

+ Office.

- Customs Departments of provinces and cities: Bac Ninh, Cao Bang, Can Tho, Dong Thap, Long An, Ha Tinh, Tay Ninh have 04 rooms, including:

+ Professional Affairs Department;

+ Prevention of smuggling and handling of violations;

+ Department of Organization and Personnel - Inspection;

+ Office.

- Thanh Hoa Customs Department has 03 rooms, including:

+ Professional Affairs Department;

+ Department of Organization and Personnel - Inspection;

+ Office.

- Customs Departments of Binh Dinh and Kien Giang provinces have 03 rooms, including:

+ Professional Affairs Department;

+ Prevention of smuggling and handling of violations;

+ Office.

- Customs Departments of the Provinces: Binh Phuoc, Ca Mau, Dien Bien, Dak Lak, Ha Giang, Khanh Hoa, Quang Binh, Quang Nam, Quang Ngai, Thua Thien - Hue; Gia Lai - Kon Tum Customs Department; Ha Nam Ninh Customs Department has 02 rooms, including:

+ Professional Affairs Department;

+ Office.

The Director General of the General Department of Customs shall prescribe the functions and tasks of the Departments of the Customs Department.

(2) Customs Sub-Departments, Post-Clearance Inspection Sub-Departments, Customs Control Teams, and Drug Prevention and Control Teams under the Customs Department (List attached to Decision 1919/QD-BTC 2016)

The Director General of the General Department of Customs shall prescribe the functions and tasks of the Sub-Departments and Teams of the Customs Department; teams and teams under the Customs Sub-Department, the Post-Clearance Inspection Sub-Department, the Customs Control Team, and the Drug Prevention and Control Team under the Customs Department. To decide on the establishment and reorganization of Teams and Teams under Teams. Sub-department of Customs after obtaining the agreement of the Ministry of Finance.
