Regulations on the composition of the Public Employees Disciplinary Council in Vietnam

The members of the Disciplinary Council for public employees not holding management positions, and the public employee management unit having no constituent units in Vietnam

Pursuant to Clause 1, Article 35 of Decree 112/2020/ND-CP, for public employees not holding management positions and public public service units managing public employees without constituent units, the Disciplinary Council has 03 members, including:

- The Chairman of the Council is the head or deputy head of the public service unit managing public employees;

- 01 Council member is the representative of the trade union executive committee of the public service unit managing public employees;

- 01 Member and Secretary of the Council is the representative of the agency advising on the organization and cadre work of the public service unit managing public employees.

The composition of the Disciplinary Council for public employees who do not hold management positions and the public employee management unit has constituent units in Vietnam

Pursuant to Clause 2, Article 35 of Decree 112/2020/ND-CP, for public employees not holding management positions and public public service units managing public employees with constituent units, the Disciplinary Council has 05 members, including:

- The Chairman of the Council is the head or deputy head of the public service unit managing public employees or assigned to manage public employees;

- 01 Council member is the head or deputy head of the unit directly employing the officer;

- 01 Council member is the representative of the Party Committee of the unit directly employing the officer;

- 01 Council member is a representative of the trade union executive committee of the public service unit managing public employees or the unit decentralized to manage public employees;

- 01 Member and Secretary of the Council is the representative of the agency advising on the organization and cadre work of the public service unit managing public employees.

Members of the Disciplinary Council for management officials who commit violations in Vietnam

Pursuant to Clause 3, Article 35 of Decree 112/2020/ND-CP, for management officials who commit violations, the Disciplinary Council has 05 members, including:

- The Chairman of the Council is the head or deputy head of the agency, organization, or unit with the authority to appoint, approve, or decide to recognize public employees;

- 01 Council member is the head or deputy of the head of the management unit or assigned to manage an employee; in case the appointing level is also the management level, the Council Member is the head or deputy of the head of the unit directly employing the officer;

- 01 Council member is a representative of the party organization of the public service unit managing public employees or the unit decentralized to manage public employees;

- 01 Council member is a representative of the union executive committee of the public employee management unit or the unit assigned to public employee management;

- 01 Member cum The Secretary of the Council is the representative of the agency, advising on the organization and staffing of agencies, organizations, and units with authority to discipline public employees.

Notable points on the composition of the Public Employees Disciplinary Council in Vietnam

- In case all Party Committees or the Trade Union Executive Committee fall into one of the cases specified in Clause 11, Article 2 of Decree 112/2020/ND-CP (amended by Clause 2, Article 1 of Decree 71/2023/ND-CP), then appoint 01 representative of the immediate superior party committee or 01 trade union member of that unit to replace.

- In case the head or all deputies of the head of the unit directly employ the officials specified in Point b, Clause 2 or Point b, Clause 3, Article 35 of Decree 112/2020/ND-CP falls into one of the cases specified in Clause 11, Article 2 of Decree 112/2020/ND-CP, then appoint 01 officer of that unit to replace.

- In the case of the head and all deputies of the head of an agency, organization, or unit specified in Point a, Clause 1, Point a, Clause 2 or Point a Clause 3 Article 35 Decree 112/2020/ND-CP falls into one of the cases specified in Clause 11 Article 2 Decree 112/2020/ND-CP, the head of the immediate superior agency of that agency, organization, or unit is the Chairman of the Council.
