Regulations on supervision by citizens of land management and use in Vietnam according to Article 231 of the Land Law 2024 are as follows:
- Citizens, either by themselves or through representative organizations, shall exercise the right to monitor, reflect, request, and propose to competent authorities to handle violations in land management and use.
- The monitoring, reflection, requesting, and proposing must ensure objectivity, truthfulness, compliance with the law; not exploiting the right to monitor to make complaints, denouncements not conformable to the law, causing social disorder; bearing responsibility before the law for the accuracy of the information reflected.
- The content of citizen supervision in land management and use includes:
+ The formulation, adjustment, public announcement, and implementation of land use planning and plans;
+ The allocation of land, leasing of land, and permission to change the land use purpose;
+ The recovery of land, compensation, support, and resettlement;
+ The registration of land, property attached to land, issuance of Land Use Rights Certificates, Certificates of Ownership of Residential Houses and Land Use Rights, Certificates of Ownership of Houses, Certificates of Ownership of Construction Works, and other relevant certificates.
+ The collection, exemption, reduction of land levy, land rent, and related land taxes; property valuation of land;
+ The implementation of administrative procedures related to the rights and obligations of land users.
- Forms of citizen supervision in land management and use include:
+ Direct exercise of the right to monitor through reflection and proposal to competent agencies and individuals for resolution;
+ Sending petitions to legally recognized representative organizations for these organizations to carry out the supervision.
- When receiving reflections and proposals from citizens or representative organizations, competent state agencies have the following responsibilities:
+ Organizing the reception, classification; inspection, handling, and giving written responses according to their authority;
+ Transferring petitions to competent state agencies for resolution if it does not fall within their authority;
+ Informing the results to the organizations or individuals who have reflected or proposed.
System of monitoring and assessment of land management and use in Vietnam according to Article 233 of the Land Law 2024 is as follows:
- The monitoring and evaluation system for land management and use is part of the national land information system and other information collected from law enforcement activities regarding land across the country, including:
+ Information about land use planning and plans; land statistics and inventory; land valuation and land use taxes; allocation of land, leasing of land, recovery of land, permission for changing land use purposes, issuance of Land Use Rights Certificates, Certificates of Ownership of Residential Houses and Land Use Rights, Certificates of Ownership of Houses, Certificates of Ownership of Construction Works, and other relevant certificates; the implementation of land-use related investment projects; compliance with land laws; inspection, examination, and handling of land violations by administrative state agencies;
+ Information about resolving land disputes, complaints, and denunciations;
+ Information from the process of monitoring the enforcement of land laws by citizens; the National Assembly and People's Councils at all levels; the Vietnam Fatherland Front and its member organizations; and other related organizations;
+ Necessary information collected through technological solutions including satellite imaging, aerial survey, and other means; field surveys and other technical means;
+ Necessary information from sociological survey data on land management and use.
- The agency with land management functions is responsible for updating information into the Monitoring and Evaluation System for land management and use to the National Land Information System; managing the monitoring and evaluation system; assisting the Government of Vietnam, People's Committees at all levels in organizing the monitoring and evaluation of land management and use.
- The monitoring and evaluation system for land management and use is publicly available for organizations and individuals to access information according to the provisions of the law.
